I just gave birth to my son last month and I filled out the form to put him on my health insurance (offered by my employer) and it was waiting approval because I was waiting for City Hall to give me his birth certificate, which is still not ready yet. Well I just found out that he is still not on my plan, and I called them to find out why and they told me it's because he has a different last name than me (I gave him my fiance's last name, obviously because we're getting married.) Then when I asked if he could go under my fiance's insurance (he works there too) they said it's too late. This is not fair! What can I do? |

It should be as long as you file a copy of the birth certificate (which will obviously show the parents' names) and his social security card, they HAVE to add him to your plan - IF your birthday comes first in the year. (if you're born in January and dad is February, regardless of who is older - he'd be on your plan. It's called the Birthday Rule.)
As long as you can prove (via your human resources person) that you filed the proper paperwork on time he HAS to be added to the plan. Insurance companies play games like this ALL the time. Fight them and do not give up!!! |

we had to have both the birth certificate and social security number for our child born last April (2006). most carriers require this. the explanation regarding last name is incorrect. you must immediately obtain the birth certificate from your state (not generally done at city hall) as well as the social security card, send copies to your insurance company (they should accept a fax of both documents). most insurance carriers will retroactively bill the hospital again, or you may have to submit payment to the hospital (at least in part) and re-submit the bill to your insurance carrier once your son is on your plan. should not matter whose insurance plan he is on, if you are not married and if the father has not made any attempt to put the child on his plan. also, "too late?" for what? birth of child supersedes any open enrollment period. have the fiancee complete paperwork to add him after you have the birth certificate and ssn card in hand. |

The last name of a birth-mother's child is irrelevant. Someone is seriously misinformed at your insurance company or at your employer's HR office. Go back and talk to them again. |

It can take up to three months for the insurance to catch up to a new baby. That's what happened with me, and we had the same last name! I ended up paying out over $600 out of pocket, for checkups & shots, and it eventually got refunded after the insurance got straightened out. |
