I live in NC. I was rear ended on an interstate off ramp by a tractor trailer. I had been forced to come to a complete stop because the 5-6 cars ahead of me had stopped. The tractor trailer was going about 7-9mph at the time. I was driving a Ford Explorer. There were only scratches on my bumper from the accident. The guy's insurance company just called to let me know they would pay for me & my 2 children's (5 and 10 year olds) medical bills and give me $150 for the scratches on my car. The medical bills came from going to the doctor to see why we had headaches the following day. Plus my neck hurt so bad I could not turn it without pain and my right eyelid was drooping for some reason. I missed a week out of work due to pain & drowsiness from the muscle relaxants my doc prescribed. Accident was 1-1/2 weeks ago ,Oct.13 2006. I didn't do a police report cause an officer directing traffic in the area said damage to my car was too minor to file. Is $150 + medical bills a fair settlement?

Sorry, I guess my question was not clear. The guy's insurance company offered to pay me $150 for damages to my car and to pay for me & my children's medical bills. I kinda think they should also compensate me for the money I lost from not being able to go to work for a week and for our pain and suffering since I did not cause the accident. I do not know if I will file a small claims case or not. |

Probably not. Get an estimate for the damages to your vehicle. They probably exceed 150.00. Medical and Bodily injury liability vary from state to state. The best thing you can do is contact your agent and see what the state laws are regarding injuries. They may owe you a settlement for bodily injury depending on your state laws. |

With such a minor impact I would take any medical settlement they offer. I would get an estimate on your vehicle before taking the $150. |

Call a lawyer! Don't sign anything. There is a reason they want to settle....probably cause they know they would ahve to pay more |

7-9 mph and only scratches on your bumper... I'd say yes, the settlement was fair...
with that mild an impact the only reason your neck hurt so bad and you missed work was because you stressed yourself into that situation... stress will cause many ailments... you're childrens headaches were probably also a reaction to seeing your increased stress level...
You should have just chilled and went on your way... It wasn't worth getting yourself that upset over... |

I would get an estimate on the bumper first - because it's possible the entire bumper must be replaced, and that could cost you $800.
I think the medical bills part of it is completely fair. You'd not get that if you sued him, due to the lack fo damage to your car. |

Sorry you will not get the 150$, but if you can prove the medical bill were a needed you will get that.
Good luck too beacuse you do not have a police report.
