That's awful! I hope you BOTH recover quickly from this horrible accident.
Well, sure, he shouldn't have ran behind your car. So he is "responsible", bot not legally. Nine year old children cannot be held legally liable. And, honestly, you're responsible too, as it is always a driver's responsibility to be aware. I'm not trying to make you feel guilty, just stating the fact.
Neither your homeowners nor your auto insurance is going to cover in this case because he is your son. You cannot collect under either of these policies for damages or injuries to insureds, and you and your children are all insureds on these policies.
If it had been a friend of your son's then your policy WOULD pay.
You're going to just need to go under regular health insurance to pay your son's medical bills.

depends on where the car was. If in your drive way then your home owners will pay if on the street they must pay |

It depends on the laws of each state. Normally, a child that young won't be held responsible.
HOWEVER. If you'e asking can your son collect under your LIABILITY section of your auto policy, the answer is NO. LIability won't cover household members. You can't sue yourself. |
