My Dad lost one of his eyes because his health insurance wouldn't pay for it, what lawyer should I contact?
Hello,

My dad is retired and on welfare. He has 3 health insurances total and a letter from one of his health insurances that states the other health insurance should pay for all of his eye costs.

He had problems with one of his eye's and he could not afford to pay $200 to this eye doctor, so he lost his eye sight in one of his eyes. None of the insurances paid for it it. I think this may be because my dad is a foreigner and they took advantage of him.

Please help me and tell me what should I do? Should I contact a lawyer and if could you please recommend any?

By the way we live in Phoenix, Arizona if it matters.

The insurance company TOLD him why they wouldn't pay for it. Most likely, it's a preexisting condition.

You can contact any lawyer you want. They won't do a thing for YOU. They'll want to talk to your dad directly. Just go to your local yellow pages. If they won't take his case, it's because he doesn't have one.

Usually, "oh, someone else didn't pay for my medical treatment, and I didn't want to find the money to pay for it myself" is NOT a valid lawsuit.

The $200 sounds like a co-pay that the insured person would have to pay out-of-pocket in order to obtain care. In the event it is a co-pay, there's nothing you can do other than waste your time and $ on an attorney and waste the taxpayers time and $ by going to court.

Maybe a medical malpractice or personal injury attorney.
You should post this question under law.

So your dad did not want to sell $200 of assets (TV, Stero, misc other) to save his own eye? And what about the family? THey did not have $200?

Sounds like you have more problems than eye sight.

Something not right in this scenario!!!!!!!!!!!!!! And it is not the insurance company.

Your answer is you should not contact any lawyer - they cost more than $200!!!!!!!!!!!!

PS: You can afford a lawyer but can't afford $200? Yikes!

Your dad didn't lose the sight in his eye because his insurer refused to cover the cost. He decided on his own to not seek treatment because the insurer would not cover the cost. That was his decision, and the insurer isn't responsible for that decision.

You can contact a lawyer if you so choose, but I'd guess that you will be told there is no basis for a lawsuit in this situation.

First, 3 medical insurance policies is too many.

Second, just because the insurance companies wouldn't pay, does not mean he could not get treatment. He choose not to find a way to get the treatment because the insurance wouldn't pay. It is neglect on his part.

Most lawyers wont take this case (unless they just want to take his/your money).

I'm no lawyer, but odds are you will lose.
