My Daughter Lost Everything In Apartment Fire... What Else Can She Do?
She has just $3,000 in renter's insurance. The fire broke out on New Year's Eve, in Virginia Beach, while she was up here in NY home for the holidays. It was fault of a tenant, smoking somehow caused the fire. Can she file a claim against the apartment complex for additional losses that her insurance won't cover (beyond $3,000)???
Does she have any other way to cover total losses?? She lost everything, and has nothing. No job at this time, she just was discharged medically from the Navy, and her Fiance' is currently in the Navy, out to sea....scheduled for deployment to Iraq next month. He shared the apartment with her. She feels so helpless at this time, and so do I, being up here in NY unable to be there with her. Any suggestions or answers will be so appreciated! The building owner will not be responsible for your daughters property. If the other tenants smoking did cause the fire she could find out if they had renters coverage and put in a claim against their insurance.

Wow, I didn't know anyone SOLD a policy that low.

She cannot file a claim against the complex. The fire wasn't their fault. She's welcome to try to sue them, but she's going to lose that lawsuit.

There's no other way to cover her losses.

I have NO idea why she would seriously underinsure herself that badly, but this is a lesson learned - being underinsured, can come back and bite you in the rear. At least it was only "stuff" she lost, maybe $10,000? It could have been worse - someone could have died. Or, if she's underinsured on her car insurance and she killed someone, she'd be paying for THAT the rest of her life.

Unfortunately, she chose to purchase a renter's policy with only $3,000 coverage. I'm not sure why she'd do that if her belongings were worth more than $3K...renters insurance is relatively inexpensive. The premium difference between a $3K and a $10K policy would be next to nothing.

As someone else mentioned, the apartment complex can't be held liable for her personal property...the complex owners didn't cause the fire and (presumably) the complex was up to fire code.

Someone mentioned the possibility of suing the tenant who actually caused the fire...your daughter could consult an attorney about that. Not sure what the odds are that she would win, and even if she did win, she'd still have to collect from the other tenant. (Who presumably lost everything they owned in the fire too. And may or may not have had renter's insurance either.)

Sorry for your daughter's troubles. Hopefully her experience reminds her friends and family who rent to double check their renters insurance policies and make sure they are adequately covered.

And, of course, I agree with the others who have suggested the Red Cross and other charitable organizations to help.

As far as I know, the only way she could successfully sue is if the building owner was not up to fire code. Red Cross may be of some help. Contacting Church groups in the area may be of some help. Salvation army. Being that the fiance had belongings there the Navy may be of some help to replace his items. Dad, you are far away but you can contact some of these agencies for her. She may feel that it is begging and be reluctant to do so.

So sorry to hear. I agree with the other answerer about contacting the Red Cross. She may want to consult a lawyer. If she was discharged medically from the Navy, I would think she would still be able to use the JAG benefits for legal advice. Did her insurance company give her any advice as to where to turn?
