due to the fact that they had accident insurrance. So they being the insurrance company said they could only pay half the bill and sent me a check. I think they were giving me the go around because I am a younger father. But anyways the baby was covered since he was born for the first 2 months but public aid so we were able to bill the accident bills to that, but that still leaves me and my wife with the check the resturants insurrance company sent us. So what are we allowed to do with that money? Because I dont want to get introuble.

The coverage that pays just because you fell is called "medical payments". It's a no-fault coverage, so it will pay out regardless of fault, but only for unpaid medical bills.
Not all restaurants carry it, because people fall ALL the time, and MOST of the time, it's not the restaurant's fault.
The OTHER coverage they WOULD have, is liability coverage. You'd have to sue them, and prove that the injuries were THEIR fault. They clearly aren't - they had no control over those kids that actually caused the fall, but you COULD sue the parents of those kids.
You should send that money in to your state Medicaid office - if they find out you got it, they'll be chasing after you anyway. |

Government insurance has superlien rights. Which means they always get paid back. You do not get to double dip on this. Send them the check as they will ask for it eventually. It does take them time but they generally ask. Furthermore, you have no right to keep that money. It is not yours. |

hmmm... that's tough, i know the insurance company will take their sweet time because they have to investigate first if it was the restaurant's fault or not and you have no choice but to get the first available resource for your child and that is public aid. i would suggest to hold on to that check, depending on the public aid, ask them if you could pay them out of the accident insurance money or/ the best way is that when you go back to your doctor pay them out of that insurance check and the medicines since they only paid you half of the bill and keep the receipts so that when they get back to you, you have proof that you used the money for that purpose. they will always say "they will never know where the money went" but its better to be careful because if the governemt knew that you got paid then they might ask for the money, you'll never know. insurance companies declares paidout claims to the federal government for tax purposes. |

i would just sit on the money until i could call and talk to the insurance co. make sure they have everything they need, as well as the hospitals and doctors. make sure your son will not need any more doctor visits either! after everyone is paid and ur baby is ok, cash it! i would also however make sure the restaurant did cover all incidentals until you are positive the baby is ok! u may need to save that money for an attorney. highly unlikely but possible

Consider it pain and suffering for your child and put it into a bank account for him/her. If your insurance company requests repayment from the restaurant's insurance company eventually they will notify you and you can then return the money you have received.
They most likely sent you the check so you would not sue them and by cashing the check you are agreeing that they do not owe you any more money. |

As far as the restaurant is concerned your accident case is closed once you cash that check.
How the hell does a baby (>2mths ) fall? Unless the restaurant offered to pay, I'd think; SCAM by the parents if I was an insurance agent.
And maybe you & your wife should keep a better eye on your baby. |
