My bank is driving me nuts ?
can the banks do this if i have say £2 in my account and i have a direct debit of £30 to be paid can the bank pay the direct debit and make me go overdrawn then start charging me £15 a day is this legal please help

WelshLad
Yes, they can. Why not get £30 in the account before it happens.

Sal*UK
Yes - you are using their money! Why shouldn't they charge you? Stop the DD or make sure funds are there to pay it.

I got charged £25 because they paid a £2 Direct Debit, when in my opinion they should have sent it back unpaid.

Banks make their money from your mistakes or irresponsililty and laziness.

Im my banks worst customer. :)

I dont use my credit cards, and if i do theyre paid off fully next month.
I dont have an overdraft.
I always have funds in my account to pay Direct Debits.
They pay me 4% return on my savings a year.

Which means my bank makes sod all from me, no actually i make money from them. Learn how to play the system ;)

Eddy T
Unfortunately that is the systems that bank takes to deter you from going overdrawn, it is some sort of a penalty charge. If you do not want to be penalised, maintain your account properly and do not go overdrawn.

The banks make the rules with the intention of maximizing their profits. So, when you authorized them to autopay, they were hoping that it would cause an overdraft. They could have denied payment, but how much money would the bank have made? Probably zero.

AAAAhhh! The beauty of Direct Debit, manage your own finance's, its much cheaper!

Banks do what they want anyway-there not legally allowed to charge you a lot of things that they do anyway..
my advice change banks or give up with banks and keep your money in a old smelly sock under your matress

A Direct Debit is an authorisation that you "sign" allowing the bank to pay variable amounts to the company named on the Direct Debit at specified intervals (monthly, yearly etc).

Whichever way you lose.

If the company taking payment doesn't get paid, they could file a statement on your credit rating reference file. If they get paid, your balance goes into the red and the bank starts charging.

Whether this is legal is currently the subject of a court case.

See: http://www.moneymadeclear.fsa.gov.uk/news/product/unauthorised_overdraft_charges_test_case.html

You can make a complaint to the bank asking for the excessive charges back, but this is unlikely to be resolved until after the case is concluded.
