My bf and I have been dating for over 2 years. Within the past couple months visitors and members of his family have been getting towed continuously for no reason. The first time we picked up the first car the tow truck men said it was our HOA, but we never recieved any notification of the change of not being able to park on the street. Last night my bf's dad parked his car on the lawn to avoid being towed since there was not enough room on the drive way, he still ended up being towed. Isnt there any rules about warnings or towing on personal property?

There is no guest parking lot. The comunity is 50 or so houses. gated. There has to be some loophole. We should be allowed to have guests over and have them park in the street if there is no guest parking. |

Most places would have signs for no parking areas, grass of course is a given no parking place. He might have it in his HOA agreement so should make sure his guest know where they can park. If he is having excess guest he might have to have them park somewhere else an carpool or borrow driveways space from a neighbor if they aren't going to need it. They may have a guest parking lot, maybe by the office. He should ask them and inform his guests. |

Your bf needs to read his bylaws. Likely, it says you can't park on the lawn, and you can only have one car in the driveway, and you can't park a car in a drive that blocks the sidewalk, there's no street parking, etc.
Yes, the lawn belongs to the HOA. Or rather, even if it doesn't belong to the HOA, the HOA controls what you do with it. No pink flamingos, they probably have rules about flagpoles, pools, playsets, what color you can paint your house, etc. They control EVERYTHING you can see from outside the house.
Have bf pull the bylaws from the purchase. It's all spelled out there. |

There may be rules against parking on the lawn in your boyfriend's community.
As for the rest of the towings...is it possible that neighbors may have complained about "excessive" visitors and people parking at your boyfriend's house? If you choose to live in a gated community with an HOA, then you also choose to abide by the rules. So, you don't automatically have the freedom to do whatever you want, whenever you want just because you're the homeowner.
(For example, I can't put a shed up on my property, even though I own the home and own the land. Because that's one of the conditions of our HOA, and I was provided a copy of the rules when I purchased the house.)
I'd suggest that your boyfriend get a copy of the rules regarding visitor parking from the HOA. And then make sure that he and his visitors all abide by those rules, or else risk continuing to get towed. |

If he has an HOA parking on a lawn is a no win. Somewhere in the bylaws or county ordinances there will be something that prohibits that. Come on.... parking on a lawn will lead to grief.
The management company that the HOA uses. They have lawyers.
My big question is why someone notices. Odds are a neighbor is making this a big deal. Or an HOA person is being the neighborhood NAZI. Something is up.
Basically your BF needs to speak to the HOA and the management company and do some leg work. If it takes going to an HOA meeting so be it. If he is not an actual actual owner nothing can be done. |
