Was this a group insurance plan offered through your employer to all eligible employees? Or was your employer paying on the side for an individual plan for you?

Makes a big difference - you have a lot more protection if it was a group plan. In that case, I'd suggest contacting the department of labor.

If your boss was just paying an individual plan for you on the side, that might be more difficult for you. First thing I'd do is dig up anything I had in writing where my boss agreed to pay the premium. Then I'd consult an attorney and/or the Department of Labor to see where to proceed.

And I might also consult an attorney about your boss trying to coerce you into getting an abortion, if that was the case...that may be construed as harassment in the workplace. Especially if your boss stopped paying your health insurance because you didn't do what she wanted. (Even if it doesn't technically qualify as harassment, there may be some other law it violates...its certainly inappropriate for your boss to try to step in on your personal life like that. Definitely consult an attorney - if you can't afford one, try the Legal Aid group in your area.)

If the employer was still taking payments out of your paycheck which gave you reason to believe you still had active health insurance and you have past paycheck stubs to show that your cut of the insurance was being withheld from your pay, I would speak to an attorney. It's illegal for employer to withhold funds from your pay for insurance, and not apply to your insurance.

The first step is to talk with your boss, confirm whether the premium was paid or not, and if not, ask why not. Then make a written record for yourself of this conversation - it may come in handy soon.

What you do next really depends on her answers to your questions. It might have been a clerical error that's simple to correct. It may have been something fraudulent, in which case you would probably have grounds for a lawsuit. Did you pay premiums as a deduction from your pay check? If so, were those deductions made for the time period in question? There are still too many unknown facts here to give a complete answer.

BTW, why does it cost $44,000 just to have a baby?

If it was a group health plan, then your employer is most likely liable. If they were just paying for it "on the side" you would need to check and see what you have in writing that states the employer agrees to provide the health insurance. Ask a lawyer.
