The main question that needs to be answered here is how did he get the head trauma. If he was in an accident and had an accident policy, it should pay unless he received the injury more than 3 months or so ago. Some accident policies state that you must die within 90 days of receiving the injury. Need more info to really be of help. |

What does the death certificate say he died from? It will list a cause of death.
If the death certificate says he died of natural causes or something like that, and you have an accidental death benefit on some insurance policy, no, they aren't going to pay.
Whoever is handling his estate or next of kin should order a copy of the death certificate from the coroner. See what it says. If it says accidental head trauma, then they don't have a leg to stand on. |

base on what I hear, i heard accident insurance rarely pays out because you have to die from bodily injury. To me, it's just one big rip off because its very rare from someone dying from bodily injury.
If your brother die in car accident, the investigation is going to take longer! They have to do an autopsy and try to replay the scenario on how he die in a car accident. You have to prove to the judge that he died by accident, but the insurance company will say that he died from other causes.
Anyway, since your brother die from head trauma, I think you can file an insurance claim since he died from bodily injury. All I can say is that get a lawyer and bring the insurance company to court and battle it out. Good luck in winning the case! Hopefully the insurance company will pay the claim before going to court. |

Well, the death certificate says how he died. If he died from, say, cancer, then yes, that's not related to the accident!
The company should have sent you a claim form, so you could fill it in and attach a certified copy of the death certificate. If they haven't, request the claim form, and if they continue to deny it, request a denial in writing.
If you disagree with the reasons for the denial, you can file a complaint with your state insurance department. |

Is it disability insurance or life insurance? What are the disability requirements for the insurance to kick in? 25%? 50% disabled?
Life insurance isn't necessarily disability insurance, and disability insurance isn't necessarily life insurance unless otherwise specified that the two are combined. They may have a certian minimum disability % requirement before they will assist you.
Read the contracts and get an attorney if you still have questions. |
