it was gale force winds today, i had parked outside my mother's house, the tree from over the road blew accross the road onto my car also damaging two houses. my mother's included. The tree belongs to a type of housing association and had been deemed unsafe by the council and was due to be felled beg of Feb. The insurer's are prepared to pay for damage to the two houses but not damage to my car, my insurer's will pay but what my uninusured losses, our excess and cost of a hire car. thanks for any advice |

The Housing Trust's Insurer is REQUIRED to cover your car as well.
You were parked outside your mothers home making you a visitor.
Her house Insurance would cover you if the tree was in HER garden.
The Housing Trust is responsible for the tree as it has already been deemed as unsafe. If they refuse to pay, SUE THEM!
I will guarantee you will win (plus get compensation for the time it has taken)
Be polite with all your dealings with them, but remain firm.

As other have mentioned as they had been made aware of potential problems with tree and have done nothing then contact your home insurance as you may have legal expenses that will help. you may also have this on your car as well. But as insurance manager you have lot going for you. The reason why the insurance will not pay for your car is you do not live there or with in a limit to what is covered by visitors.Its the council who are responsible. |

Check with your insurance company again I am sure that the act of God clause is defunked if not try the insurance ombudsman etc. It used to be a force majure clause in legal terms but I am sure that now. Also if you can afford it try taking on the councul as they hve obiviously stated somewhere that the tree was unsafe and tht the current bad weather has proved it so. Best of luck |

If tree known to be unhealthy than they are liable for not taking care of it. Their insurance should take care of it |

If the owners of the property were aware that the tree was dangerous and had been planning to take it down, but hadn't taken it down yet, they should be liable because it is their negligence. If you have trouble with them, report it to your insurance company, it would be covered under comprehensive, and let them try to get reimbursed for the damages. |

I'd sue the insurer. they are responsible for all damages including your car since the tree was deemed unsafe. |

If it was a healthy tree there would be no liability on the part of the housing association, but since the tree was deemed unsafe, the housing association knew about it they should be paying the damages to your vehicle.
Call their insurance company again and ask to speak with a claims supervisor. |

I had a similar situation last spring...how most companies work is that your car will be covered by your policy. Trying to get your Mom's home policy to pay will probably be a waist. I'd be very agressive in getting estimates. Typically I'd get 4 from dealerships because they will give you a higher value for the damages and more money to you.
