My car is totaled, city is at fault I have mild neck pain howmuch should I settle for?
no credit card, so no rental. I feel being stuck is form of pain and suffering. No way to carry tools, so cant work. Broke cellph. in mishap, also. Had to walk over 10 miles to get new phone. Now, leg hurts...is this suffering? No med. insur. so didnt go to doctor. Its not injured bad, but theres discomfort. Less each day. Each day, though, frustration grows...todays only fourth day with no transpo. Dont want long drawnout thing...so, no lawyer. Just want whats fair. Car bluebooks for 1600. Miss 200 per day sitting here. Ph. was 100. Tow was 140. Neck will be ok, I hope. but...theres stiffness less every day. Lifes on hold, basically.

Here you people go with your lawyer happy ways. That is poor advice.

Here is the deal, most states have laws that require you to mitigate your damages. That means minimize your loss. For example... if the accident was your fault would you still just be sitting around? What would you do to get yourself back to preaccident status. With regards to what you can claim as an injury you can not claim injury for being frustrated. You are not able to make a claim for wage loss due to lack of transportation. You can make a claim for your phone, your vehicle, tow bill and maybe an injury. You normally have to have had some treatment to claim an injury. If there was no treatment it is possible the will offer you some money for 1 doctor visit and a small amount for inconvenience but you would have to sign a release of all claims. I would have offered you about $200. Not all insurance companies work the same and state laws differ. It is possible in your state that you have to have a certain diagnosed injury or a certain amount of medical bills before you can even make a claim for pain and suffering. The bodily injury portion (pain and suffering) can only relate to injury and expenses related with that. In other words you are out of luck on the wage loss. Good luck

w/o a lawyer, it's going to be pretty hard to settle w/ the city. they'll keep u hanging on for yrs & if they settle at all, it'll be far less than what u should get. besides, u gotta prove it's their fault if u take them to court.

Without a doctor verifying injuries, don't expect anything for medical or pain and suffering. The 200 a day for not working you won't get unless you can prove you were unable to work. Lack of transportation doesn't count. That leaves 1600 + 140 + 100 = 1840. If they offer 2000, I'd be happy.

This happened to me and I wanted to be fair too. Now, I have bone spurs in my neck....steady pain in my neck....and one day I'll have to have surgery. That was 13 years ago. So Get A Lawyer and SUE.....Do not settle.

Settling? There won't be pain and suffering - due to governmental immunity laws, you'll get either the deductible amount on your car, and YOUR policy has to pay out the collision coverage, or if you have no collision, they'll pay the physicial damage. They won't pay any medical, that has to be covered under your policy.

Don't believe me? Call a local attorney and ask. They won't take the case if it's governmental, because you can't get any real $$.
