First of all if you try to do it with your insurance your deductible for comp ( That's if you have physical damage coverage on your vehicle) will kick in and is usually 500 dollars which is a lot more than if you repair it yourself, if you have lower deductibles then you're in luck. You should talk to the manager or owner of the car wash so they can fix the problem but if you left that place already without notifying them they might say that it was not their problem since you didn't notify them in time but of course you can come back and tell them that you didn't notice it until later. |

Since the car is paid for and depending on the damage I would have the check made out to you. Get at least 2 estimates and give the car wash owners the best. They should pay .... and quit honestly I would enhance the estimate for the time it took you to "get" the estimates. (travel time and gas). If they don't agree then court is an option and their insurance company would pay you + expenses since they don't want to go to court. |

When you say your car is paid for does that mean you paid for the repairs? Probably not, but just wanted to check. If this is the case then the check should go to you, you would just show the insurance company / car wash owners the receipt.
If an insurance company is giving you a check they will usually want that payment to go to the body shop unless you have a receipt showing that you already paid for it.
If the car wash owner is paying for the damages then they can just make the check out to you, they don't really have an interest in whether or not you get the car fixed, if they hassle you about it tell them you'll work with their insurance carrier on this instead...they don't want their insurance carrier to know about it. |

You will want to take the car to the body shop and get an estimate for the repairs. Take the estimate to the car wash. If the owner agrees that it is reasonable and he'll pay for it ask him to make the check out to you if that is what you desire. He has the option of paying you directly or the body shop.
He may require you to take the car to several body shops to get estimates if he doesn't think the first estimate is reasonable. |

Not everything is about "rights"!~
Right now, they've agreed to pay for repairs. Give them estimates from 2-3 shops, and ASK Them to write the check to you.
If they don't, you can always bring them to small claims court.
On the other hand, if the car wash were my client, I'd be advising them to pay the body shop - or offer you 75% of the body shop cost payable to you, because I'm pretty sure you won't get the repairs done. |

Did you notify the car wash manager? And, did they acknowledge that they were at fault? If they did then you are entitled to anything you want, within reason of the damage made. If you have an advocate then I suggest you take it up with them. Because you could get the check or the repair, depending on what you want, and if you are entitled to it. |

If you are using the car wash's insurance the check will be made out in your name only. If you use your own insurance company you may have to submit a copy of the title to show sole ownership and no lien holders. |

Car wash has commercial insurance which should pay for the damages to your car. Do not get into any deal with the car wash owner. Instead - file a claim with their insurer.
1. Insurance is easier in paying for the repair compare to an individual.
2. Insurance claim will reopen within a year if you come up with some damages, which you might not be aware right now. |
