Can I keep the check. It was made out just in my name. I went to a repair shop nearly a month ago, and they said they would order parts, and call me to have me drop off car I agreed, but when I got this check for 4,000.00 three weeks ago, I have been fighting with myself as to whether or not to get car fixed. I own the vehicle and can live with the small amount of damage (mostly cosmetic). Am I obliged to the repair shop, even though it has been almost a month, and I havent heard anything from them. Will I have to pay them anything for ordering parts, if they are looking for some money from me? What would you do? |

You can keep the money if you want since you own the car. There is nothing unethical or wrong with that. People do it all the time.
With regards to prior answer. Any potential injury claim has absolutely nothing to do with the property damage. By signing off on your car you are NOT giving up any rights to a potential injury claim. Her advice is wrong. |

Do you currently owe anything on your car? If so you need to get your car fixed. The money is for you whether you fix your car or not. But you will have to pay for the parts you ordered. I would suggest fixing your car. |

well, no you are not obligated to get car fixed. BUT, when you sign your name on the back of the check that releases the others insurance company from any and all future claim to be made against the driver of the car that rearended you. If you are 110% sure your car is ok and you back/neck will have no problems in the future then sign and cash the check. I know from experience that some back and neck injuries wont show up untill months, even years later. My hubby was in 3 rear end accidents, no physical injuries except the typical soreness/stiffness after such an event. That was 7 years ago and he has on at least 6 different occassions in the past 3 years had his lower back, and his neck give him problems. He has had xrays and MRI's showing that there is a few disks in both neck and back that are herniated due to injury of some type, this according to the radiologist. I am 100 % sure it had to do with the accidents he was involved in. So my advice to you is, be more that absolutly sure you are ok before signing the back of the check. Good luck |

if they have not done anything to get your parts by now they aren't going to....they (parts) don't take that long to come in...the moneys yours if you want to drive it with the damage go for it...they can't make you fix your car. (and parts are driven in from a supply place...with other stuff so no you will not be billed) |

if the car has no lein holder, and you are the sole owner, I would say that it is up to you what you do. If you did not sign any agreements with the repair shop and you still have not heard from them, I would go about my merry way. if you did sign something read it carefully, and make sure that you are not obligated, even signed agreements have time limits and it doesnt look like they are in any hurry to accomodate you...so in my book, no you are not obligated. |
