Additional Details We live in MD, she is 27 and lives on her own. She hydroplaned, he hit her and now the couple are suing and the wife separately etc. He did have one broken rib but now they are claiming everything inc affection issues, etc. it was 2 yrs ago.

If she does not have any assets, most plaintiff's attorneys will not pursue compensation beyond the policy limits.
She needs to refer the matter over to her insurance company. Defense counsel will be assigned. They will do everything possible to settle the claim within the policy limits. From experience this is usually the case. I have never seen an attorney or plaintiff seek recovery beyond the policy limits unless the defendant was grossly negligent or had assets.
Also, just because they are suing for $500k does not mean that is what the claim is worth. All allegations need to be documented. A fractured rib is only worth about $5k. I often see lawsuits which include every imaginable trauma related injury with ridiculous demands. Soft tissue injury law suits in NY often have a statement of damages which exceeds $1MIL! Most loss of consortium claims are added just to increase the value of the claim. It is doubtful the adjuster will even consider including her claim. Sounds like they are money hungry.
Let her insurance company do their job. She should be ok. |

If she had insurance at the time of the accident:
You need to call your insurance adjuster as soon as you get the suit papers. Your insurance company will hire (and pay for) an attorney to defend you - per your insurance policy.
However, you have to get the suit papers to the insurance adjuster ASAP. The insurance company has 30 days to get an answer on file. The clock starts running as soon as your daughter gets served.
Your adjuster will get the papers to the defense attorney. Make sure your adjuster has current address and phone numbers for you and your daughter. The insurance company will need your cooperation in defense of the suit.
If you have questions about your specific situation - ask the adjuster. The adjuster is familiar with the facts of your case, your coverage limits, the type of injury claimed and the venue in your area. We can't tell you about that stuff.
I will tell you - law suits happen. Most claims settle with out them - but some go into suit.
So call your adjuster. There is no such thing as a dumb question. Ask any question you have. |

That would be helpful.
However, usually attorney's only go after the amount of insurance you carry. There maybe exceptions especially depending on how bad the accident and the injuries are.
So, you may want to post the age of your daughter, the state and the details of the accident to be a better answer. |

Assuming she has car insurance, the insurance company WILL defend her in court. Whatever the judge says she has to pay, her insurer will pay up to the policy limit, IF she has to pay, and then they'll get a judgement against her for any balance. They can attach future wages, etc.
But if the injuries are minor, they won't get that kind of judgement. |

Your daughter's insurance will cover her first and foremost. However, the insurance co only has to pay up to the limit of insurance. If your daughter is underinsured, she may be liable for any excess judgment.
It is always advisable to seek the advice of a lawyer who is experienced in this area of law. |

The insurance company will pay up to policy limits. When they do this they will get a release in full so that no one can come after you for the additional amount being claimed. If the case goes to court the insurance company will provide your daughter with a defense. If they are insisting on going after her for excess over policy limits she might need to get an attorney to protect for the excess. Most cases will settle for policy limits if there are no assets. If your daughter hydroplaned then there may be no fault against her. The insurance company will be handling all this on her behalf. |

They'll be suing the insurance company for it. The lawyers for the insurance company will try and knock the amount down. They never go after anyone without assets because it's a waste of time and money on their part. If your daughter is independent and living on her own, you should be safe. But if she is underage and living at home, they might try and get your assets. |

Wait a second, if she has insurance, the insurance company has to pay, even if your daughter were a billionaire. As long as she has 500K coverage. If she had, let's say 300K coverage, the insurance company would have to pay 300K, and your daughter would have had to contribute 200K.
