Happy Girl | My employer stopped my medical coverage behind my back, but still deducted medical payments from my checks? |
Since February 2010 until June 2010 my employer sneakily stopped my medical insurance to keep the money. I found out I was pregnant, and they promised to restart it and never did. I now have $4,000 of bills they promise to pay.
I was just reminded that I should be also asking for the money they took from my paycheck saying they were paying medical insurance, because they weren't. And I continued to receive the same amount every month. Is this right? |

Are you sure you were not insured from February to June? How did you find out? If you are pregnant, did you try to see a doctor during that time, and learned you had no coverage? Did your employer switch to another plan? How do you have those bills if you told the doctor to bill your insurance? Did the hospital or doctor tell you after you spent $4000 that you had no insurance? |

You can request EITHER that they return your premiums to you, OR that they pay what the insurance company would have paid, on your behalf, up until you found out that the insurance was cancelled.
AFTER you find out that the insurance is cancelled, they ONLY owe you a refund of what they deducted from your pay.
You can file a complaint with your state labor board, about the payroll deductions. And you can try to get a lawyer to sue them, but odds are, they're going under anyway, and won't even be in business by the time it goes to court. Can't get blood from a stone. |

Shame on them. They owe you the premiums back, and should cover your expenses. Plus be sure they restart your insurance. You can take them to small claims court or get a lawyer if they don't comply. What they did is fraud. |

This is fraud. You need an employment attorney to sue them. The normal course of action is that the employers are forced to back pay the premiums to keep your policy current to cover the past charges. Either way, your employer is on the hook both CRIMINALLY and CIVILLY. They can go to jail for this. I wouldn't bring that up with them till you talk to a lawyer, though. I would also send a letter to the bill collectors for the hospitals and doctors explaining that there was an issue with your health insurance premium deductions and that you are working on it, and that you intend to pay them. If that isn't good enough for the medical billing folks, pay them whatever you can afford while the matter is being resolved, and then bill the employer for every cent that you pay once the matter is resolved. |
