Unless any of you co-signed on the loan or assumed responsibility for the payments, you have no obligation to pay.

Car insurance an GAP coverage only apply when the car was involved in a wreck. GAP only when the car was totaled and the value of the car is less than the payoff amount.

If no one accepted responsibility and no one cosigned, tell the finance company they can take the car.

You misunderstand. Car insurance is for accidents and damage. It has nothing to do with paying off loans.

If ownership/use of the car is transferring over to you (or to whoever else you are referring to in the "us" group) than you are still responsible for the payments regardless if you co-signed for the loan or not. I am not sure if this holds true if you decide to relinquish ownership of the car though.

Car insurance is for if the car is in an accident. Was the car in an accident? That is the only time they pay. And, gap is the same. It pays if the car is in an accident and totalled.

The kind of insurance you should be thinking about is credit life insurance. Check with the bank and see if he had that on his car loan. That is the only thing that will help you. But most people don't take it. You have to make those car payments unless you want them to repo the car.

Auto insurance covers comprehensive and collision damage to the vehicle and/or another's vehicle as a result of the insured's fault, not to cover loans.

Why is the company holding you responsible for the payments? Is your name or someone else's on the loan? If so, then the person who co-signed with him but is still alive is responsible.

One of the answerers up there is wrong -- if your FIL died with a loan on the car, the financing company/bank has a lien on the car, and he would not have been able to transfer the car at death to someone else if it was in his name only. That would be because he didn't own it if it was not paid off. Gap insurance is most often offered by the bank/finance company, but some insurance companies offer it to. Still, it would have nothing to do with paying off the loan.

Unless someone else's name is on the car who is still alive, the debt is TOTALLY your FIL's. Let it go and let the finance company/bank take the car back. Period. End of story.

No, full coverage is for damages to the vehicle or to someone else or their property, not for paying off a car loan.

And GAP coverage just means that if the car is totalled, and the value of the car is less than your loan balance, the GAP coverage pays the difference.
