My fiance' recently passed away in a motorcycle accident,?
his motorcyle insurance cancelled a month before he passed he was at fault , and the other party insurance company sent me a letter stating that his estate must pay for the damages to other party, but he doesn't have an estate only thing he has is a bank account that has $ 5.00 dollars in it so what happens now?

Since your fiance has no assets and no estate and no insurance, there is nothing they can do. They can't come after you or his family because none of you are legally liable for the accident. I'm very sorry for your loss. P.S. Be sure that you have any and all checking and saving accounts separate from his or they will attach your assets as being his.

They are out of luck. You can't squeeze blood out of a turnip.

just hanging around
dont worry about it. its not your problem. nothing can happen to you.

mbrcatz
Well, YOU can ignore it, you're not executor of his estate, OR next of kin.

NOTHING is going to happen. If you WANT to, you can send a letter back, telling them he has nothing, you're not executor or next of kin, leave you alone.

My condolences to you. I think the best thing you could do would be to speak to an attorney. What a difficult thing to have to deal with. I am so sorry.

The executor of the estate simply writes a letter with the proof attached, essentially saying, "Sorry, the estate is broke. He is deceased. Good luck."

No one else can be held liable, so you can sleep at night ... well, at least over that part. Sorry to hear about your fiance'.

someone
Unfortunately, since his 'estate' is not much, the other party will not be able to realise any compensation. the loss is theirs too. Nothing can be done by anybody now.

If you were not married to him and were not related to him by blood, the insurance company has no business coming after you. That $5.00 bank account IS his estate, so it's all they can get from him. They're high and dry and you're out of it (which you were once he was pronounced dead).

stephenweinstein
There is an estate; it consists of the $5 bank account. Technically, the estate must give the other party the $5 unless there is another debt that is entitled to be paid first, but once the insurance learns that there is only $5, they may decide not to bother with the forms to claim it.

momof3boys
unless he made you in charge in his will and left his debts to you then you don't have to worry, they can't get money where there is none. Chances are they won't see any money. They can though get a judges order granting them permission to all his belongs to auction off to pay for the damages.
