My hospital didn't file the claim for my admission and surgery and now my insurance won't pay, what can I do?
My insurance gives the hospital 90 days to file a claim, and they did not. So, my insurance company won't foot the bill, so the hospital is asking me to cough up the money. The bill is for a surgery and 2 weeks admission, so it's pretty hefty. What steps can I take now to amend this? I considered just not paying because it's the hospital's fault, but that'll hurt my credit, so what should I do?

Simply call the billing department and ask them to provide proof of timely filing on the bill. Explain to them that your policy has a 90 day filing deadline and the claim was apparently not received in that time frame. Most of the time, it's a simple remedy.

If the hospital says that they had a glitch and the bill wasn't filed, have them document that and then ask them what they will do to make it right. You are correct in assuming that this is not your fault, but as a careful consumer, you should try to help remedy the situation. Get someone in your employer's benefits department to help you appeal the insurance company's decision-that's what they're there for. I'm willing to bet that, if you keep a cool head and get everyone talking, the claim will be taken care of.

file an appeal and make a formal complaint to your insurance regulator in your state. If this is a group plan, contact HR and have them contact your broker. Brokers have relationships with carriers you wouldn't and can push these things through for you. I do this all the time in my business. If your not on a group plan.. file the appeal and report the hospital and carrier to the state.

If the hospital did not file a claim then I would send the bill to your insurance company. They should not fault you for the hospitals mishap. If that doesn't work then keep asking for a supervisor until you get this resolved, I don't think that they can legally not pay it. However, I am not a lawyer but have been in a similar situation.

first you need to talk to the mgr or director of admission. they are suppose call your insurance and verify that before your date of service. did you pay your copayment? did you sign any papers in preop? it is the hospital fault. they are suppose to call to verify? how long after did they fill the claim? the hospital will have to write it off as a loss. talk to the director first!! good luck

You need to verify that 1. the hospital was in network with your insurer and 2. that the contract between your hospital and insurer states that the hospital has to submit the bills within 90 days to be covered. And if that's the case, check to see if there's a clause, in that contract (you'll have to ask the health insurance company) that if they fail to submit the bill within 90 days, they are not allowed to ask YOU to pay it.

You CAN'T ignore this. But you CAN make it go away, if that clause is there.
