If you are the named beneficiary in the policy, you should call the life insurance company about the process of claiming the death benefits. (I think there are instructions on the policy as well.)

Your child can receive benefits from the policy but it will go through probate. Technically, you have no right to the money. However, you should get an attorney asap to discuss what this means. You need legal advise.

guardianship refers to the care of dependant's, not money. You are either listed as the beneficiary or not. Most common-law / marrriages usually automatically name the spouse as the beneficiary, unless he has named someone else.

The insurance company can't pay the benefits to a minor. Also, as the spouse, you are often entitled to at least 50% of the proceeds. Contact the agent or insurance company for specifics.

You can file for conservatorship. Not a guarantee that you will be granted this however it is possible. If the money is in a trust, then you would not necessarily have access to the money as well.
