My insurance company wants me to sign this paper:?
I have filed a claim with my insurance company due to the breaking and entering of my vehicle for the damaged done to my vehicle.

The insurance representative wants me to sign a "Proof of Loss" and a "Trust Agreement".

I do NOT feel comfortable signing this document. He also will NOT release a copy of the adjuster's report until I sign this.

Do I have to sign this? What are my rights?

I wouldnt mind signing the paper if the amount on the paper were worth settling for and im not going to sign something that gives them the right to cut a check less the deductible and then sue the guy and keep the deductible from the check and from the guy as well.......im getting screwed both ways!

Never heard of a "trust agreement" what does it mean?
The proof of loss is very standard form. Sign it. Or it if you feel either one is incorrect contact an attorney for review. The carrier will wait. They have no choice.

OK, the proof of loss is required, in order for your claim to get paid.

You're not entitled to a copy of the adjuster's report. Period.

Regarding the deductible, it's going to get subtracted from the payout, and the subrogation rights then go to the carrier.

These are all contract terms, spelled out in your policy. You agreed to it, even if you didn't read the policy. If you don't sign, they won't pay - and they'll be absolutely right to not pay, as you, the insured, are not cooperating, and don't want to follow the terms of the policy.

If the insurance company recovers the deductable they have to refund that to you they can not get paid both ways.
