Life Insurance avoids probate unless she did not have a beneficiary named. Then it would go to her estate and through probate. Unfortunately, she didn't get the beneficiary changed before her untimely, sad death. Whoever is the beneficiary will get the money to do with what they please. Sorry for the sad news. |

If he is the named beneficiary then I am afraid the money is his. The life insurance company has a legal responsibility to pay that money to her ex-husband. Sorry to be the barer of bad news. |

The insurance company must, by law, pay the benefit to the named beneficiary(ies). That is why it is so important for people to keep their beneficiary designations current. What she told you will not change things. |

Sorry, no. Life insurance beneficiaries supercede a will, etc and no matter whether they were married, divorced or separated, if he was named as the beneficiary, he gets the money. That is something to think about when you are naming a beneficiary in the future. Sorry, it stinks, I know. |

Sorry for your lost and this answer is not going to make it any better. Whoever is the name beneficiary on the life insurance policy will receive the death claim. In this case, its her husband. The courts can't do anything about this since its in the contract.
Only thing you can do is try to influence him to give you and your siblings some money.

You are probly out of luck if he is the named beneficiary. Call the insurance company and ask. You never know. She may have changed it. And, if she had an attorney check with that person too.
If you think it might help, contract your state's Dept of Insurance or Insurance Commissioner.

No, there's nothing you can do. Whoever is the named beneficiary on the policy at the time of death, gets the money. |

I am not sure which country you are from but it sounds like you need legal advice. If you are from Australia it will depend upon if the life insurance was held inside a superannuation fund or if it was a policy with a life company. If it was held within a super fund, it will also then depend upon what type of beneficiary - there are two types and under one of them, it is the trustee of the super fund who has the final say as to where the money goes. The recipient has to be a financial dependent. |
