My mother-in-law has money taken from her account from FSA. How can we find out who that is?
My mother-in-law died recently. We checked at the bank to see if she was paying on any policies. There were 4. Two of them were contacted by the funeral home. We are waiting on them to send the information back to us about her policies.

The one whom we are not able to contact is FSA. They take a $4.00 draft out of her account each month. I looked up FSA and found hundreds of sites. She was 81 at her death. So we are fairly sure that she wasn't paying on a student loan.

The bank has refused to let us know anything other than they let FSA draft $4.00 each month.

Do you have any idea as to what it could be? One draft goes to AARP, one goes to GP, the other goes to someone-to whom the funeral home knew. They say that we have every right to tell the bank to let us know who the drafts went to. So far, they won't comply.

What should we do next? And, how do we go about getting a copy of her will. There is only one child. Everything was to go to him.

I'm guessing blindly here, but shouldn't there be someone who has legal clout as the executor of her estate? This person should be able to get the bank to release any and all information pertaining to her finances in order to do their job properly, which is to execute the estate as mandated in the will.

I just realized you said you don't have a copy of her will? Is there a family attorney who might have a copy of this? Or in the event that she left no will, then the state laws regarding estate inheritence should be in effect. (probably some sort of next of kin situation) If that is the case, you will probably need the death certificate and get a judge or issue some sort of decree or whatever it is that names a person as executor of her estate. Which then gives you the legal clout to kick open some doors.

have you checked her house for bank statements?
The older generation likes to store important papers in shoeboxes in their bedroom closets.
Also even if it was automatic drafts the company should send statements to the person paying the bill.

As stated earlier, the fsa is usually through the employer. I know she was probably retired, in that case the FSA would probably still come from whoever was providing her health benefits at the time of her death. You may want to try contacting the HR dept.

You will have to go through her papers and files to find a copy of her will, unless she left a copy with a relative or her attorney.

If you can't find the will, you'll have to assume she doesn't have one. You'll have to go to court to have an executor of her estate appointed, and with that paperwork, the exector should be able to get the info from the bank, and if she's got a safe deposit box there, access that. The will might be there . . .
