My neighbor's tree fell onto my house. Who should pay for the damages?

Your insurance policy will apply.

Your neighbors policy will not cover your house.

If the tree was healthy and the hurricane brought it down - your neighbor is not legally responsible for the damage to your house.

You would file a claim with your homeowners insurance.

The fact that it was an "act of god" does not matter. Acts of god are covered losses.

In some coastal areas, you have to have an endorsement that provides coverage for named storms.

Your agent will be able to tell you exactly how your policy will handle the situation.

In the mean time-- take a few photos of the tree. It's OK to cut it off the house and put up tarps. Do what you can do to cover the damaged area so no further damage happens. If the tree caused your house to be unlivable.. let your insurance company know when you report the claim.

When you get big storms like this -- the insurance company is going to get slammed with a lot of claims. Go ahead and report yours. However, they will try to get adjusters out the the worst houses first.

It may take some time to get an adjuster out to you. The insurance company will bring in extra people from out of state. But even then....there are way more claims than people to work them. Please try to be patient. The insurance company has not forgotten you...but it could take a couple of weeks to get an adjuster out to you.

Their insurance company will pay for it.
I hope they don't carry a high deductible.
Home deductibles can be from 0 to 10,000 dollars.
Talk to them. Offer to pay their deductible.
That will keep you guys friends. But don't do it under your plan, it may increase your rates. Oh, by the way, don't mention that fact to your neighbor.

Just talk to her. She'll do right by you.

Then again that Caliban guy might be right. It could be considered an act of god, or it could be considered like hurricaine/wind damage.

In most cases, the your neighbor's home insurance will pay for the damage. The liability insurance will come in play. Also, it depends on where the location of the tree, if it between two houses and as a common property, then both yours and your neighbor's insurance will be responsible for the damage. Most likely 50/50 split. Hope this would help!

Just kidding. Under normal circumstances, since it's your neighbor's tree, the neighbor or his home owner's insurance would pay for damages. However, since the damage occurred during an act of God, your neighbor probably isn't liable, and, most likely, your home owner's insurance doesn't cover such an occurrence either.

You may be royally screwed.

under normal circumstances, your neighbor. from storm damage, its a toss up. both will claim its not thier problem most likely :P
