 Advise on home and auto insurance?
I am changing my existing insurance company and I have 3 to choose from. I would like to have advise which of these 3 is the best.

i believe he is. with things like this they have to draw the line somewhere, and the line in this case is that it was his property blowing onto your property, bottom line. no matter if it was his fault or not he is still responsible for it. it's unfortunate for him but there's no other way to get around it.

still not convinced? think of it this way. it isn't your fault that a storm came and it isn't your fault that he didn't have his umbrella secure in the event of high winds, so you shouldn't be responsible for the damages.

of course i could be very wrong and you could be proper f$%& (what movie did that come from?)

Your own homeowners insurance should cover this.
Your neighbor's insurance would only be liable if the neighbor was "negligent". The fact that he was the owner of the umbrella is usually irrelevant. Your neighbor did not cause the wind. You did not say if the umbrella was open or not, but even if it was, you would have to show that the neighbor new, or should have known, that the wind was going to blow it free from the table, and into your house.
Very difficult to prove.

The Act of God answer would be more correct. It's not as if he picked it up and threw it through the window during the storm? If the same storm would have blown your trampoline onto his car and damaged it, you wouldn't be responsible just because you own the property. That's why we all should insure our property! For his insurance to pay, he would have to be Liable for the damages and this case he's just not...

No way. Your insurance pays for damage to YOUR home, his insurance pays for his. It doesnt matter where it came from. It would be covered as its a sudden and accidental event.

Your neighbor is not required to pay until a court order he or she to.

You can persuade the court to make such an order if you proved that a reasonable person could have foreseen and prevented the act that caused the damage.

This case is a typical negligence case.
When you have personal property on your premises you are responsible for them, and have to be proactive to avoid any liability risks. If it was windy, he should have put the umbrella away, as it was a foreseeable event that happened.
Wind is a covered peril (dont know where these ppl get the idea of "Act of God"). Get his insurance information and file a claim with his insurance company.

Hell yeah they should pay for the damages cuz common sense would tell him to take the umberella down if a heavy storm was about to hit
