okay...last friday 9/29 i was on a main street in myl home town which is very busy around 12p.m...i was on my way to work...when a woman stopped dead in the middle of traffic...well didn't stop in time...so i "bumped" her..and I say bumped b/c no tail lights broken.no dents, no scratches, no nothing, except that her bumper need "tapped" back in (literally)....okay...so i grab my cell phone and call 911 cop comes...she tells him (woman is in her 70's) that a man/woman cut her off and she had stopped...okay...didn

okay...so I didn't get cited....well I called my insurance company PROGRESSIVE...and made my claim....she did not go to the hospital told me she was fine....she goes to the doctor and says her heart hurts...she had a panic attack...(i know this b/c her daughter comes in my hair salon, and she is the one who took her)...am I responsible for her hospital and car?

Hello,
Here is the bottom line on accidents that involve pedestrians. 99.9 percent of the time the automobile that hit the person will be sited, and the fact that you hit a 70 year old lady (think grandma) is not going to play out well with a jury.
Make sure that you are cooperative and provide the insurance information. That is about al that you can do, because, it is you vs, the "little old lady in the crosswalk"

Unfortunately, the only way you are not guilty of either following too close or careless driving is to prove she backed into you.
From what you said, she wasn't driving backwards.
Hope they go easy on you. Remember - she could lose her license for ever......which is probably going to be sooner than later.

To start with in almost every state, if you rear end someone it is your fault. You are suppose to be looking where your going. It is a big scam in some places. The woman doesn't have to be hurt right away, It's post drama. During the accident adrenalin is high and therefore you don't feel the pain right away. when the body calm down the mussels losen up and that is when the pain starts. So are you responsible? Ya, just ask anyone in the Law dept. |

I know you're not going to like this answer, but, you are likely going to be held responsible because you rearended her. Presumably, the car behind should be far enough behind that they can stop under those circumstances. Even in a comparative negligence state (such as California), the rearender is likely to be "at fault." |

Yes, you are. There are standards of fault. It doesn't matter WHY she stopped dead in front of you. You hit her. It doesn't matter if you were cited or not.
If somebody "rear ends" the car in front of them, they are at fault. It means you didn't keep a proper distance between you and her. If you had, you would have had time to stop when she slammed on her brakes for no reason.

Little old lady 0% responsible.
This is due to the fact that by law, its worded slightly differently from state to state but same major point, you are supposed to follow the car in front of you at a safe distance. This means that if the person in front of you applies their brakes as hard as they can you should be able to stop without hitting them. |

yes, you hit her from behind. it is your responsiblity to keep enough distance between you and car in front of you that you can stop in situations just like yours. thats why your insurance company opened a claim on your insurance. |

You're at fault. Cited means nothing. The cops don't determine fault for accidents, and getting a ticket or not getting a ticket makes no difference where an insurance investigation is concerned. She was able to stop for this car that cut her off, but you weren't. Progressive will pay this |
