My son was burned in a house fire, will the homeowners insurance cover his expenses?
My son was spending the night at a friends house when a fire occurred and he suffers from 3rd degree burns possibly needing skin grafts. We cannot afford these costs and they have homeowners insurance.

I would consult an attorney in this matter. Your attorney will be able to review the Fire Department's Report on the fire to determine if the homeowners' were negligent and are therefore liable or maybe if there might be any liability on the part of some unknown party (for example on the part of a manufacturer of faulty equipment that could have caused the fire). If the homeowners are liable your attorney will initiate a claim by writing a letter to the homeowners and asking that they contact their insurance carrier to begin the claim process. If they fail to respond or the insurance company fails to settle appropriately, your attorney will file suit against the homeowners on your behalf. You should obtain the attorney through a referral preferably from the Bar Association, a local law school or through your local Legal Aid Society. Please do not just get an attorney from the yellow pages or television ads since these are usually not the best attorneys and might not have your son's best interests in mind. Depending on his age he needs the best possible assistance in this regards. Third degree burns are nothing to play with since they result in mostly permanent scarring, leave the area susceptible to sun burn and while they are healing are very susceptible to infection.

If the homeowners are not at fault, your only other option will be the Medical Payments coverage on the homeowners insurance which usually has a limit of $500 to $5,000 (available to anyone who is not a resident of the insured household who has been hurt on the property) and your own health insurance.

I would advise to seek legal advice. If they have homeowners insurance and they were considered at fault, then their homeowners should pay.

Again seek legal advice, skin grafts are very expensive and can take a while to take... your son could be in and out of hospitals for a year or more... the legal route would worth the time and effort since fees and dr. bills can add up quickly.

He would have to sue them, and they would have to be NEGLIGENT. There has to be FAULT, for their liability to pay.

Now, there's a NO FAULT coverage called "medical payments", but it's usually somewhere between $250 and $1,000. So THAT should pay, IF the homeowner files the claim. But it won't go very far.

Was the homeowner negligent in causing the fire? Or, worse, was your SON involved in the fire, like smoking in bed or something?? Because if you open up this can of worms, and your son was involved in ANY way, they ARE going to countersue YOU, for the damages from the fire.

The problem in such a situation is that you cannot "file a claim" with another party's insurer. And you cannot sue the other party's insurer.

Either your health insurance will cover costs and pursue recovery against the other party or you will have to sue the other party directly.

Depending on the type of insurance they have

However most home insurances ( in Canada at least)
come with
"Third party Liability " close, also known as "Civil Liability"
this would cover any damages they unwillingly inflict upon other,
material or bodily damage. For example if a post man gets bit by
a dog, and their responsibility is proven, insurance would have
to cover post man`s injuries.

So if your son has no life insurance, or med.insurance , or if it is
insufficient, their insurer would have to cover the gap.

Unless your son caused the fire ( obviously not)
he should be covered.

If they have no home insurance, your son could sue the homeowners for bodily damages, since the event occurred on their property...
( that s why ppl get insurance with civil liability , in the first place, to avoid that)
