If he was the owner of the policy, he would have named a beneficiary. If he didn't it would go to his estate. If you are taking insurance out on him, and he is a minor, then it should likely be the person who is providing for his care until he becomes an adult. If he named someone, that person does not have to use the proceeds for burial or medically related expenses that the person incurred. |

If your son has not left a will, then it goes to his next of kin: His wife and children, if he has any. If not, to his parents. What you do with it in that case is up to you. |

Ignore the comment about it not being you. If your son had life insurance, or if you had life insurance on him, the proceeds will go to his beneficiary stated in the policy. |
