okay, on sat our water heat broke- water was boiling out of the top and my laundry room was flooded and my floor was flooded with about 2 inches of water. we called them and they told us what our deductible was and told us to go ahead of have a contractor replace the water heater and fix the water damage. it also was very cold outside and they asked if we needed to be in a hotel until the work is done because we had no heat and no water and 2 small children. we said no because the weather was gonna be mild the next day and we could make it through one night. so the man came and fixed the water heater and all the damage. and my husband called on monday to fax everything which they received. he called yesturday to see the status and now they say they wont pay it because it was an act of god and they dont cover it. ! wtf! Additional Details so my question is.. since the man was so easily able to tell us yesturday that it would not be covered, why couldnt they tell us that on sunday when we made the initial claim and the rep said to go ahead and get someone to fix it and told us what our deductible was? it makes no sense. in 2002 our washing machine broke and flooded the house(it was overflowing for hours)! when we came home it was like walking in a swamp. they immediatley told us to get someone to come out and fix everything. we paid our deductible and they took care of the rest. in 2006 our ac unit was struck by lightning and they had to replace that. and they did. it sounds like they are trying to find anything to not pay this one. but how the hell were we supposed to know that the water heater would bust? she told us to go ahead with the work and we did. now they deny the claim. 3 days after they said "okay, lets get it fixed..blah blah blah, this is your deductible etc. |

Contact your agent--that's part of his job. Give him the facts (and no attitude--HE didn't make that "decision.") He can tell you what your policy does cover and how to process the claim AND if you need him, he should be able to intervene if you were told that the situation was covered.
I just had MY water heater burst on New Year's day--hope that's not an omen. Thankfully it's in the garage, not the house, BUT I have a ton of stuff in the garage. As my deductible is $1K, I will NOT be filing a claim with them. However, I ALSO have American Home Shield which a home warranty and they covered a substantial portion of the bill. It helps.
IF you got the name of the person who even offered to put you up in a hotel, etc. let your agent know as well. I suspect someone was a new hire and messed up with your claim and the "act of God" line.

Of course you should fight it. Demand a claims adjuster be assigned with a claim number. Ask for an inspection of the loss. (they have to). Do you still have the water heater? A water heater that burst is not an act of God. Something mechanical happened. If you have the water heater keep it or attempt to recover it from whom ever took it. Tell State Farm that you will file a "bad faith" lawsuit immediately. You have some options on this loss. |

thats NOT an act of god. it IS covered under your homeowners policy unless you have some crazy exclusion on your policy. get your policy out and start reading. if it does not have an exclusion on this then they HAVE to cover it. State Farm is NOT one of my favorite companies. Did you go directly to State Farm or through an agent for them? call them back and tell them you want to see in writing on your policy were it excludes this. if it does, they should be able to provide you a copy of the exclusion from your policy. then go find a new company! |

It sounds to me like the water heater simply malfunctioned/broke. It would not be a covered loss since there was no fire/wind/theft/lightning/etc that caused it to break. The person who took your phone call probably didn't know enough about your policy to tell you that it wouldn't be covered. That is the claims adjustor's job, not the phone operator. She was right in telling you to get it fixed. What were you going to do, just wait a couple of days with no water to see if it was covered? If it wasn't covered, are you saying you wouldn't have gotten it fixed? That doesn't make any sense. I can't tell you why the washing machine was covered since you didn't provide enough details. |

OK, several things. If this WASN'T a covered claim, were you just going to let the water keep flooding the house for the next six years? You have a DUTY under the policy to fix the problem, and MITIGATE the loss - that means, keep it from getting worse. So obviously, you need to fix the hot water heater - replace it, actually.
I'm sure they're not denying it because it's an "act of God". Act of God isn't an insurance term, it's not in any policy. Heck, *I* have a State Farm homeowners policy, and it doesn't say "Act of God" anywhere in it. What it DOES say, is sudden and accidental bursting of an appliance. Which is what this is.
So for the water heater - or the washing machine - they usually cover the same thing - the damage caused by the water, but not the mechanical breakdown of the appliance itself.
You can ask YOUR agent for more clarification, or just pull out your policy and read it. |

That's not an act of God. An act of God would be your water heater breaking due to a tornado or hurricane damaging your home. Contest it - and if you have to... HIRE AN ATTORNEY.
Your water heater can break without it being too hot or too cold outside. Now, if the repairman said that it broke due to the lines freezing - that could be a different story, but I would DEFINITELY hire an attorney because they told you to go ahead and have it repaired and obviously to send a fax of the repair bill to them. |

I have had very similar experiences with State Farm. They didn't want to cover water damage for burst pipes (long story - renter). Anyway, I worked with my agent who initially said there was nothing he could do - the decision came from higher up. So I told him I was going to the state insurance commissioner and I would fight it. So he finally went to bat with State Farm and they paid for it. Then I had another similar incident with state farm and water damage. Once again they did not want to pay. In this case, however, the damage was less than my deductable anyway so I let it go.
Continue to fight it, since you did get a verbal OK. |

If you have flood insurance it should be covered....as for act of god....that's lingo for try and collect from us.
I can't see how failure is an act of god..that term could be used for everything from a car accident to your house falling down.....Talk with a lawyer.
Sounds like a breach of contract to me. |

BOSCH TANKLESS HOT WATER pipe under flue had flozen due to 14 deg temp out side State Farm ststed as hot water tank not covered in there warranty. This is not a Tank .Said if no hot water go to hotel and this is covered? i bate. said to get water removeable team out this is covered. And said to get the tank changed out asap.. Waiting to show agent the break in the pipe due to freeze. STATE FARM said they cover pipe that freeze and break. Lots of damage hard wood floors to remove and replace glue downed. |
