No Fault Insurance?

The No-Fault laws vary from state to state. Most relate to injuries and not damage to a vehicle. States with No-Fault require Personal Injury Protection coverage. This coverage pays for medical expenses and lost wages to all occupants of a vehicle, regardless of fault. Depending on the NF state, you may or may not be able to file a claim for non-economic damages.

If you live in MI, you can only file a mini-tort claim up to $500.

If you were not at fault for the accident, you can file a claim against the other party. No need to start suing anybody unless your claim is denied.

Where did this accident occur, and how did the accident happen? This info will help answer your question.

I only can answer that question for the state of NJ. No fault regards to medical bills as a result of the accident. Regardless of whose fault is the accident, each company will pay for the medical bill of his/her insured.

No fault is for PIP....personal injury protection and you have to find out if yours is a participating State. If someone hit you and the accident was their fault, yes you would look to their insurance company to repair your vehicle. Your best bet is get a copy of the police report and bring it to your auto agent. Hope that helps!

No fault means, you collect under your own policy, no matter what.

Now, in reality, very few states are pure or "true" no fault.

So, the REAL answer is, if it's a pure no fault state, you collect under your own policy, or suffer the loss - you can't sue them.

The REAL WORLD answer is, you need to ask your agent, who can give you state specific information.

No fault insurance isn't EXACTLY no fault. In many cases, a police officer will issue a ticket against one of the parties in a car accident. That pretty much proves fault. You could take that person to small claims court to get back your insurance deductible (and you can bet your insurance company will go after the other person's insurance company for the repairs they covered). If you suffer personal injury, you can sue them for costs of medical care and other expenses.

The problem is you have to be able to show that the other person was at fault. If you don't have a police report, you'd have to have witness testimony that is strong enough to show that the other person is at fault. If the other person didn't get a ticket and you don't have at least two credible eye-witnesses, you're better off suffering the loss because you'll just waste time and money going to court.
