Our business has slowed down a lot and we can not afford the lease. We have lost several agents. ?
We had 4 offices leased out and now only 1. What we are paying per square foot is very expensive compared to what is on the market today. We want him to renegotiate the lease, but he is not willing to. If we move out he will not get what we are paying for. If we just move out and he then tries to sue us for what we owe, should we file bankruptcy to help? Need options please.

Is it a business lease or are you personally on the lease (or both--corporate with guarantee). What kind of assets does your business/yourself have? Will a bankruptcy affect your licensing for insurance?

If you are going to need to rent again, filing bankrutcy when you can't meet the terms of the lease may cause you heartburn in getting another lease.

In all honesty, this really is your problem and your fault. (I am just trying to be practical). I feel for your plight, but it isn't his fault. He probably is looking at this from his standpoint, which is that he had a lease and now her probably views it as you trying to get him to absorb your economic plight (pointing out that he won't get more if you move out etc.) Perhaps if he sues you, you all could go to mediation? I would try and approach him humbly and understanding that he isn't here to fix things, but that you will do everything in your power to fix this, but unfortunately your power is limited.

If you have a corporation he can't sue anyone personally for the loss of you moving out. If you leave after him not willing to renegotiate with you, you can be sure that he's going to pursue this in court. If you file BK, make sure that the lease/landlord is included so anything else that he comes after you for would be included later. If you have a corporation, you could disolve it and start another one later with a slightly different name.

Your lease is legally binding regardless of what the current market is. You can ask to renegotiate, but your landlord is free to say no. If you choose to move out, the landlord can sue you for outstanding rent or any penalties as outlined in your lease. If you are giving up on the business anyway, and you don't have a personal guarantee for the lease, then you might just want to walk away, but think very carefully about the consequences before you do so, because a lawsuit over unpaid rent could be the nail in the coffin that closes your business for good.

If you move out and he sues you, he'll get the judgement.

So, by filing bankruptcy, are you willing to sell all your stuff to pay him off?? That doesn't make sense.

You're stuck in your lease, unless he'll let you out. You should probably sue the three people who broke THEIR subleases with you.
