Susan H | Parent stole insurance benfits from children, how do i report it? |
My father left $ for my niece and nephew when he died, and neither of them collected, choosing to let it accrue interest. One is still a minor, the other has since turned 18. When he tried to get the money he found out that their father had secretly taken all of the money from both kids' accounts and "put it into an account that even he can't touch". He's stolen a large inheritance for the same two kids from another family member, and I KNOW the money has been spent. How do I begin to get the money back? My nephew needs it NOW, and I'm the only still living connection between the kids and the deceased. His family chose not to take any legal action the last time he did something like this.. I intend to. From what I can tell, because of the amount and how he did it, it would probably be a class 4 federal felony at best ... insurance fraud ... theft by way of receiving. Any help, please? |

The 18 year old is an adult in his own right. He has the ability to take legal action (civil) on his own behalf.
Perhaps you can be supportive by going to visit an attorney with him and helping him explore the issue further. |

good luck, you probably will get nowhere because he does not have any $$, because you are not harmed by the action. the kids would have to take the action and they usually decide not to. grandpa's mistake was putting it in an account with the irresponsible dad could access. don't bank on getting anything back. it probably won't happen.
if you want to pursue legal action, then you need evidence, forged checks or signed stuff that you probably don't have. the police are unlikely to investigate this for you. |

Well, children do NOT get money left to them - their guardians do, and their guardians can spend it on the kids needs - like food, clothing, shelter, medical bills, or invest it for the children as they see fit.
If he COULD access the money, which apparently he did, then apparently he had the RIGHT to do that. Minors cannot get insurance money - so he must have been their guardian, or executor of the estate in accordance wiht the will. I seriously doubt he did anything illegal.
So, regardless of where it is - likely an 18 year old is going to have to go to court to have a judge make the legal guardian of the money turn it over, and it's NOT going to be cash, for an 18 year old. Most of the time, the minor has to actually be somewhere from 21 to 25, to actually get their hands on the money.
The place to start, is a police report, filing criminal charges against the person, and then hiring a lawyer to sue him. It's going to COST you money to do the second part, which you may or may not recoup in the long run - but unless the 18 year old needs the money to pay MEDICAL BILLS, likely a judge is not going to release those funds, anyway. |

You will need to talk to a Will and Estates lawyer about this problem. They will be able to advise you on what to do. They will be able to tell you if there is a way that you can reclaim the funds. The lawyer will also probably want to check the bank records of this individual, or they will have to get permission. If the guy has nothing to hide, then he won't mind giving permission for the lawyer to check the bank records. This type of lawyer is specialized with dealing with the money from inheritances and what was stayed in the wills. If the money was left for the two of them, then this father had NO right to take the money. It was not his to do anything with. |

I'm no lawyer, but the best advise I can give is to contact a lawyer and your local police department. Tell them what's happened, and see what they say. Often times a simple internet search will show you local lawyers who offer free consultations and that specialize in insurance fraud cases. You will need to get the police involved as they have to file charges against the Father. As to getting the money back, as long as it hasn't been spent, the courts can order whatever bank or financial institution that has the account to turn over the money to the children. If you can prove that the Father does not have the best interests of the minor child in mind, they may give you control of the money so that you can put it somewhere safe.
Again, best advice I can give you is to contact a lawyer, you'll need one either way. |

I would start at your local Social Services office since this might be considered a type of child abuse. If they can't help, they, at least, should be able to point you in the right direction. |
