I was the passenger in a car with my girlfriend and we were in an accident that was her fault.
We both had to go to the emergency room.
When we received the Medicals Bills she sent them to her insurance company to cover, as she had full coverage.
The insurance company for whatever reason did not pay the bills on time, and it went to collections. When we recieved the phone call we immediately contacted the Insurance company and they payed the bills.
The problem is that it was reported in my credit report as a 30 day late payment. My girlfriend no longer carries Insurance with them due to this problem.
Is there any way that i can get this removed from my credit report? The bill has been payed but the damage was done to my credit.
Who should we contact that can get this corrected, and what are the chances it can be removed?

Before your bills are sent to collections, the faciltiy must send you a statement of your bills. If they are not paid within 30 days, they send a late notice. If your bills aren't paid in another 30 days, you get a notice that your bills will be turned over to collections, if not paid within a certain length of time.
Bills are not usually sent to collections for at least 90 days, if you are communicating with the facility.
Did you and your girfriend give the insurance information to the hospital, so the insurance company could be billed direct?
How long after your girlfriend sent in the bills to the insurance company did she call about the claim?
Was the insurance policy written by a local agent, or was it one of those internet or TV only companies? I believe that if it had been a local agent, you would not have had the problem.
How much time was there between getting treatment until you received notice from the hospital?
Remember, an adult patient is totally responsible for their medical bills, even though there may be insurance that will ultimately pay for treatments.
You had plenty of time to call the facility to explain your situation, and contact the insurance company prior to the bills going to collection.
The facility would have worked with you until the bills were paid.
Do you know for sure that these bills are on your credit report? You can find out free, by going to www.annualcreditreport.com. This is free once a year.
If the late payment is on your credit report, contact the facility and ask if they will reverse it.

Likely not. Ultimately, YOU are responsible for your own medical bills. They would reimburse you, but it's YOUR bill, not THEIRS. |

YOU are responsible to the doctor/hospital to pay your medical bills. The hospital doesn't care who caused the accident; they provided services to you and you are financially responsible. You have to pay the bills, then pursue reimbursement either through voluntary payment from your friend's insurance company or, if necessary, by suing your friend. Her insurer is NOT responsible for paying your medical bills "on time." It's an imperfect world. |

Call the STATE Insurance Commissioners office and hang on until you get some help... You must be able to furnish all the details for them... Ask them to please write and get all the needed information. You should have detailed everything yourself.. I hope they can help you.. |

~~You need to obtain a free credit report from the main credit reporting agencies to start. Go to www.freecreditreport.com and they will let you do this online. It's our right to have this once a year without charge. When you view your report, you will see a dispute this information on the form along with instruction-just basically explaining the situation. It may help to have a record information of the insurance company and when they paid that claim on hand so you can have the contact information for the credit agencies. Once they get all this information with your dispute-you should receive the updated reports with this information removed. Be patient, but it will go away! Good luck |
