Hi,
my wife has had her place of work broken into over the weekend and a xmas present she'd had delivered to work has been stolen along with other goods (of her employer).
Where does she stand legally? Can she make the employer pay (present was worth £70) for it or claim on their insurance? Additional Details Thanks for the answers so far. Unfortunately our home insurance excess is £100 and the product was bought on a debit card not a credit card :( |

Chances are that the employer has no coverage for employees' items. And at £70 it sounds like it would be under any deductible you might have, should your contents/homeowners insurance cover theft off-premises (some do, some do not - at least here in the US).
There's no harm in having your wife's employer check with their insurer.
Another possibility is to check and see if the credit card company you used to purchase the gift provides coverage. Many do cover if the item purchased is lost, stolen or destroyed. Call the credit card company and check!

I am sorry to say, but I don't think that the company will cover it, as yeah it was on their property, but it is NOT their responsibility to make sure that your wife takes her stuff home or leaves it at work. Any workers who leave their personal belongings at work, always has a risk that they won't be seeing their stuff when they arrive at work again. The best idea is whenever there is something that she does not want to have stolen, it is the best idea to make sure that she brings it home, or leaves it at a reliable friends house if it is a christmas gift for a family member that she doesnt' want to see it. |

I agree with Smashers answer, but the only light at the end of the tunnel is do you have the home contents insurance that covers your belongings away from home? If you do, you can at least claim off your own insurance. I had my handbag stolen from work many years ago and I claimed off our contents insurance, because the business insurance would not pay out as the office door was not locked. |

In the US, 10 percent of the homeowners contents coverage is covered off premesis (college dorm, suitcase, in the car) subject to the deductible.
I would attempt to recover from the employer. |

I dont think so as the present was not belonging to the employer, unless their insurance policy covers employees belongings ect, which is doubtful. I think she should ask her employers about it and if it doesnt cover it, she'll have to suffer the loss. It could be much worse it could have been a really expensive gift. |

Dont think they can claim on their insurance because it is your wife's personal property.
My husband had his Ipod stolen from work before and they couldnt do anything about it
(You could check your house insurance because some have cover for items away from home) |
