A few months ago I broke my ankle and now require surgery. At this time I was under my mothers health benefits, but now I am not. We notified the employer that we needed continued coverage and have yet to receive any information. My understanding is that legally they have 14 days to send the information. My only problem is I already canceled surgery once and have to have the surgery before the end of the month. Is there any legal action that I can take? I dont want to be a pain in the butt since my mom still works there and I dont want to jeopardize her job, but I would like to walk eventually. It hasnt been like we havent addressed the situation- we have called and went to the HR office every days since before I even lost coverage.
Any one have any prior experience or suggestions? Additional Details I stopped being a dependent as of 10/31/08- my mother has been to the HR department everyday (she works for QVC) informed HR that we would be needing COBRA the week prior to my coverage ending and handed in a written request the day that my insurance was ended.
I am aware that it is going to be expensive but its much less expensive then the $10,000+ surgery that I need and the PT after.

By law they have 14 days to notify you. If your mom's employer goes through a 3rd party to administer the cobra, they have 30 days to notify the third party that you are eligible. Then the third party has 14 days to notify you that you have the option of electing.
If they're past their timeframe, you or your mom could contact your state's dept of labor--they're in charge of making sure business stay in line with these guidelines. |

Katie is correct about the timeframe so you should be getting the information any day now. Loss of dependent status is a qualifying event for COBRA. You will have to pay the COBRA premium from November 1 so you should schedule your surgery even if you don't have the information yet. Let the billing department know you are getting COBRA and they'll work with the insurance company. |

Depending on your state there is a time limit to offer you Cobra, also a time limit to take the Cobra. I would send a certified letter requesting the Cobra application and information. State in the letter that you have requested this information and give dates. If they do not respond, they will be responsible for all of your medical bills. You will need an attorney. Your Mom needs to also send a letter requesting the same information. Find out the time frames for Cobra election for your state. |

Your mom's employer has 30 days to notify the carrier of your status change, then they have 14 days to get the COBRA paperwork to you. Try contacting the carrier directly. The carrier may be able to expedite it for you. |

When did you cease to be a dependent?
When did you inform the employer of that event?
Usually, the plan says something about your mom having only 30 days to report the status change.
Have you put aside enough money to pay for COBRA? It's easily $400+ a month just for you. |

IF they are subject to Cobra laws. They might not be.
Why did you come off your mother's benefits? That's relevant.
If they arent' subject to Cobra regulations, there's nothing you can do. If your mother dropped you during open enrollment, there's nothing you can do. |
