Question about Unemployment- will I be denied?
I live and work in California. I am currently employed and I have been working there for three years. My husband has been laid off and on through out those three years due to the economy and the trade he works in. He was offered and accepted a job, however it has cause us to relocate.

I informed my employer of the situation and I asked if I could work from home or some how continue working for them by telecommuning. [They have other employees who live across the state] They turned me down and said they wouldn’t be able to keep me with the company. Now I’m going to be moving without a job. Since I was denied to continue working with them, I gave them my notice.

In my notice letter I basically said I had to move due to my relocation and that since they did not have a position available to me at the new location I was giving my notice.

With giving my employer the option to have me continue working for them from a far, and they intern denied me… do I have grounds to collect unemployment until I can find a new job?

I guess I want to know; will I be denied and have to appealed and go before a hearing?

Additional Details
How do you pay into unemployment benefits?? I thought that working with a steady company and paying your taxes means you paid into the "pool"

You will be denied because you voluntarily quit your job. Not, sure if they'll consider you eligible after the hearing, my son is going through the same thing. He's applied for a hearing, we haven't heard back yet though. But, for sure you will be denied up front. He is in the exact same situation. He was working for a temp agency in TX, he had to move back to California for family reasons and applied, but again, he was denied.

You should go ahead and file. The worst that will happen is that you will be denied benefits. And so what if you have to appeal? Go through the process and let them make the final decision.

All too often, people who qualify won't even file because they THINK they will be denied.

You will have to apply. The employer will most likely contest it, you can appeal, but you will probably lose the appeal.

If the employer doesn't bother to contest it, you'll get your benefits.

I think you should file. If you offered to continue working from home, and were turned down, that may be enough to qualify, given that they have other tele-commuters. Just the simple fact that you had to move away from the place of employment may be enough to qualify.

You don't know until you try. Once you get settled in, go the the Unemployment/Labor Departmennt office and file a claim. THey will contact your previous employer and if he contests the claim, a hearing may be scheduled. If so, and he does not attend or respond, you will win by default. You can appeal any decision that is not in your favor. Keep any correspondence that you may have about the situation. It may be helpful.

If you are awarded benefits, you will be paid retriactive to the day of termination.

If job loss is involuntary, you may be eligible. I'm not sure if you have to previously pay into unemployment benefits.
check with the unemployment benefits office in California.
You'll find something, enjoy the time off for a bit...
