Question about insurance liabilty when driving a drunk friend home in his car?
My friend asked me to drive his car for him to pick him up because he was drinking. I picked him up and on the way home got into a fender bender at my fault. His insurance paid for the damages done to the other vehicle, but he does not have complete coverage for his car and wants me to cover 800 dollars in damages done to his vehicle. I do not feel responsible for this. I have minimum coverage. Will he be able to take me to claims court? Am I liable for his damages?

You know, the responses above are hinting truth but off base.
This is how cops and insurance companies view it. The LIABILITY follows the CAR, while the RESPONSIBILITY follows the DRIVER. So if John is driving Steve's car and John hits someone else, Steve's car insurance pays the damages but John is the one that gets the ticket from the cops, and John is the one who gets a "surcharge" on his insurance because it was John's responsibility to drive safely.

On the other hand, by choosing to NOT have complete coverage for his own car, that meant your friend was assuming full responsibility to any damage done to his car if he hit someone else. If he wanted other people to drive his car around, he's affording them the same coverage he affords himself. He should have taken out full coverage so that if 'another person' damages his car, it's covered (if he wanted compensation for those damages). I think in a court of law, you could argue that point.

Tell him that - and tell him the next time he wants a sober cab AND his car in the morning, he better be his own designated driver!

I don't think you can be held to the damages, but it's also dependent on what state you live in.

Sure, he can take you to court, and likely he'll win. You're not liable until a judge says you are.

But if he takes you to court over a measly $800, and makes you pay, when you were trying to do him A FAVOR, well, that would be the last I had anything to do with THAT guy.

With friends like that, who needs enemies??

Some friend...if he had been driving he'd have a dui on his record. The way I look at it he owes you money...attorneys for dui cost about $2000 - that doesnt count fines or program fees.
He is not accepting the fact that he put you inthis predicament. Perhaps legally you are responsible...but true justice should prevail in your friendship and the friend should be a stand up guy and pay for his own repairs. He was smart to ask you to drive but he is lucky that you are such a thoughtful friend.

When you slipped beneath the steering wheel of his car, you accepted liability for any damage that you caused to his vehicle while you were driving it.
If the accident was your fault, then you are liable for the damage due to your carelessness.
Failure to take proper care of another's property, while it in your possession, is an action that is recoverable under the coverage of a claims court.
If you don't want to be responsible, then don't drive another's vehicle.
