This is "voluntary parting". You loaned your camera to her, she lost it.
You need evidence that she borrowed the camera, evidence of exactly what camera it was and how much it's worth. That's about it. |

Why don't you have your mom call her mom and sort it out in the grown up way.
You can't sue anyone, you're not old enough to file suit. The other girl cannot be sued, she is too young. Your mother will have to file suit against her mother.
If the other girls mom disagrees it would be up to your mother to prove that the other girls mother was negligent (not the girl, as she cannot be sued)
I can tell you right now that if the mom's can't sort this out, outside of court... you will not win this case, the burden of proof is on you. |

legally...YOU and the other girls are minors, you had an implied contract when you loaned her your camera. Unfortunately for you, all minors who enter into contracts can void them.
Try this, calm down and accept the fact that the camera may be gone.
I know it is not easy, but just let go of the camera.
Now, without ANY angst towards the other girl, go and visit her and her mom and dad and explain calmly that you need to have your camera returned. State your intention to leave with the camera and then wait. Do not blow up. See what happens. Be polite . You may not get it back, but let them all sleep on it. As long as you are not mean or aggressive, you will have done WAY MORE than suing them. YOu will have been civilized and mature and that is the only thing you can do.
I am 46 and I still loan people stuff and sometimes I don't get it back. But I don't want to stop being generous and I keep my energy positive. You are lucky to have been at the inauguration...many people would have liked to go but you DID see it.

You need PROOF that she took possession and lost it. If you have a copy of an e-mail or text message, that will usually seal the deal. Depending on the state you are in though, you are a minor who is filing against another minor and that may represent legal issues. You may have to file against her parents. You need to do some research about your jurisdiction. |

You wouldn't sue her because your both minors. Your parents would sue her parents. If you have any receipts or manuals for the camera to show what type it was and the value that would be of great assistance in court. However since there is no other written agreements there isn't any other paperwork to bring with you. If there was anyone who witnessed you agreeing to lend her the camera or saw you giving the camera to her make sure to bring them to court. Also make sure your parents let the judge know about the conversation they had with her mom and how she admitted her daughter is an apparent kleptomaniac. Her mom cannot be your witness because she is the one being sued! Just remember to STAY CALM, don't freak out and answer the judges questions with polite answers and make sure you address the judge with Sir, Ma'am or Your Honor. Do not react to anything the other party says and don't interrupt. Pissing off the judge is the fastest way to screwing your case. |
