Seeking health insurance with a pre exisiting condition..not eligible for cobra?
Not eligble for cobra because company leaving has less than 20 employees. I have a daughter in college and a high school junior.

I reside in the state of Ohio and my daughter is attending school in NYC. Son is in high school and will turn 19 next Feb.

Understand that when COBRA says 20 employees, it isn't talking about just full-time employees, or those on the health insurance plan. The law makes no differentiation.

Most states have a state continuation law for those businesses that do not meet the COBRA guidelines, and many times they mirror the COBRA requirements. Check with your state Labor or Insurance Department.

I am not familiar with the laws of Ohio. However, I highly suggest you contact the Insurance Commissioners office in your state and ask them about your rights. In Oklahoma, you can be turned down for health insurance for medical reasons with an individual plan, but we have a high risk pool that is guarantee issue. If you have no medical problems, and individual policy will be the best way to go. You can also write an individual policy for only your children, and get in the high risk pool yourself if you have current conditions.

Even if you're not eligible for COBRA, you should still have what's called "creditable coverage" if you've been with the group plan for at least 18 months.

If you have creditable coverage, you still have options under HIPAA (as long as you do not have a lapse of longer than 63 days.) Basically, coming from a group plan with creditable coverage, no individual company can turn you down, even with pre-existing conditions; however, they can (and will) charge you based on those pre-existing conditions. You should check out the link below (to the Dept. of Labor) for more info.

And if you could tell us what state/region you live in, we might be able to make more specific suggestions.

** Edited to add:
You may very well be better off to write a separate policy for your daughter in college. They are several plans available that are geared specifically for college students. Again, I'd need your location to specify any, but it may save you some money to go with that option.

you can try medicare or i think AARP.. Cobra is really strict. my mom was at her job, a casino.. she was a dealer.. and she has Multiple Sclerosis.. well they denied her b/c it got so bad where she couldn't work at alll anymore.. so yeah.. cobra isn't very good.. so i think she has medicare now or something.. but she can't put me on it.. so you might not be able to get your daughter on it.. but yeah.. check those out.. and maybe blue cross blue sheild too
