You aren't going to get nearly what you think you should, your injuries were very minor and you may get enough to cover bills and that's about it. Not worth even getting a lawyer for this. And stop witth the nightmare crap, no adjuster will believe that one anyway. |

If they don't give you what you feel you're entitled to, you can speak to an attorney. if you go that route, make sure he only agrees to 1/3 of whatever is recovered above the amount you have already negotiated on your own.
Also, if you feel they're low balling you, tell the adjuster you think you need to talk to an attorney. This may 'encourage' them to move their offer up a bit. |

~~If you seek a settlement the rule of thumb for compensation is three times the amount of your total out of pocket costs. Remember, it isn't a good idea for a settlement unless you are 100% positive, you nor your children will need any future medical care down the road.
If they won't pay the entire amount this comes out to, then you need to weigh in your negotiations as to whether hiring an attorney, versus taking a reduction would be in your benefit. An attorney will run you approximately 30 percent out of your settlement.

Pain and suffering settlement is negotiable. Provide specific examples of pain for the kids as well as you. Explain their nightmares and any other signs you did not notice before the accident occured. Their goal is to get you back the way you were before the accident, make sure that happens.
Second part is the scheduled release, usually negotiable, they may throw a figure like $5000 in medicals for you to use for the next 60 days for any treatment you desire. It looks like you have minor injuries so treatment will not be a big issue, the pain and suffering you will need to state your case. Preparation is key. |

The easiest thing to do is to just talk with the adjuster. See what they offer and then make a counter offer. The settlement process is one that requires communication.
It does not sound like much of an injury. The most I would expect you to be able to get is 2x your medical bills. But that would be on the high side.
As far as the kids go - there are no medical bills but each was shaken up. I'd probably offer around 500 per kid.

You're not going to get anything for "emotional pain". For injury, since you've got a minor injury, and six chiro visits, you'll be lucky to get cost of medical bills.
