You little friend is about to get sued. According to her insurance policy terms, the insurance company has to pay for a lawyer to defend her. However, if she lies or doesn't cooperate with her insurance company, it could void her policy. That means she would be stuck paying for lawyer AND paying the eventual judgment against her.
She has to call the insurance company. They probably already know about the DUI and that she's lying to them. |

Scared of what? Something she can't avoid anyway? Her rates rising or being cancelled anyway? The insurance will find out, either through the police report of the accident or her report from the DMV. Just call them and be done with it. Take your lumps and learn a lesson here. Don't do it again!! They probably already know anyway. |

That is good that the other party's insurance company took action right away in fixing their customers car.
Your friend needs to call their insurance company too. Your friend does not need to hide the DUI because it will be on the police report and they will find it. The DUI will not effect the claim. However, it will effect your premiums or the company may drop your friend.
Most states have insurance programs for high risk drivers like your friend. But its just liability. So, you can check the website below for help if they get dropped. |

The insurance company is GOING to find out about it. They'll get the police report, and it will show that she was arrested for DUI. One of the questions on the claim form is, "was anyone charged with DUI". So she'll either have to lie and say no, or tell them yes. And if she lies, it can jeapordize coverage.
Odds are, her insurance company already knows. I'm sure the other party would have mentioned it to them. |

yes! definitely talk to someone. A lawyer may be better. The worst thing that will happen is her insurance company will just let her take the blame, which appears to be the same situation as it is now if she does not talk to anyone.
It sounds like the other party's insurance company wants MONEY... and it doesn't care from who. Best is to have your friend's insurance company talk and negotiate with the other party's insurance company.
Depending on her coverage, she should be covered for this incident. In the future, her insurance rate will increase, but it's a lot easier to swallow increased monthly payments than a huge one time claim.
This is my experience. In the past, I was a pedestrian crossing the road and a car stopped to let me cross. A truck behind that car did not realize it and hit the car. Everyone was OK and the police came to file reports. A few weeks later, I got a phone call from the insurance companies of the truck saying I had to pay for damages to both cars, even though it was not my fault. I was really scared and I was lucky my mom knew a lawyer. We talked things though and he found a solution for everyone.
One thing you will find out: insurance companies LOVE to take your money, but getting money from them is impossible. The insurance company is calling your friend because they don't want to pay out, they want you or your insurance company to pay instead.
