Should I accept an offer of a direct cash payment for an auto accident, or should I insist on filing a claim?
I was involved in an auto accident recently with the 16 yr. old daughter of a reasonably wealthy man. He approached me at the scene of the accident and told me he doesn't want his insurance involved. He offered to pay me cash for Dr. visit and car. I don't really know what I should do. Can anyone make a suggestion? He has been very persistent that I accept his offer and do not file, it has become bothersome to me. I want him to leave me alone about it. I decided to turn in the claim, and he continued to call me. His insurance agent says he will file the claim later, if an agreement can not be reached between the two of us. I am to the point that I think I will accept his offer, so he will back off. I don't even know how much money I should accept. I was mildly injured, and my brother was also mildly injured. My car is older and not very valuable. The cost to repair it is probably more than the worth of the car. I need help.

He has not made an offer of a specific amount. He has told me directly that he will take care of it, and when I tried to file the claim at his insurance agent's office they told me, I should accept his offer to take care of it, and he made a gesture of dishing out money!! He is a wealthy business owner in my town. I think he is waiting for me to approach him with an amount. His agent said, " If we can't reach some type of agreement, then I will file the claim."

personaly i would accept the cash. he will stop bothering you. Even if the accident was his fault your insurance rates will still go up. he doesnt want his rates to go up so this is probably why he is offering you cash. If you accept it he wont bother you, your rates wont go up and you wont have to deal with the hassle of filing a claim and insurance companies that never like to pay

What does "turned in the claim" mean? Did you file through YOUR insurance or are you trying to settle directly with his?

If you know the guy that hit you, I'd suggest you ask for direct cash payment. It'll be better for both of you, and your relationship with him.

If you don't know him and have the time to file a complaint to the his insurance company, it'll be the same outcome only he will have to pay more in his monthly insurance bill. (he will be angry)

If you want to sue him for more money, you should have a lot of spare time to do this and willing to piss people off (slowly destroys the economy too). But hey you have more money what do you care about other people.

If you aren't satisfied with his offer, then file it!

If you are concerned about you and your brother's injuries from the accident, then it probably is best not to settle like that.

If you foresee some hospital bills, then by all means, file the claim.

How much is he offering? I've never seen anyone pony up a check for over $500. I don't think he's going to pay, in the long run.

If he is so worried I would demand $50,000. Obviously there is some reason he does not want to have insurance deal with this, either his daughter is not on his insurance or he is worried (rightfully so) that his rates will go through the roof. Dont let him strongarm you, you have the upper hand.
