You can't refuse payment as a way of punishment.
You have to treat the theft seperatly from the payrol administration.
The refusal from you to pay him would be treated as a seperate case, the employee will have reasons to report you for refusal to pay, EVEN if you reported him for theft.
If you have proof of his theft, you could find out if you have enough proof to fire him for that. |

As others said you have to pay. The theft is a seperate thing where you have to PROVE that the person stole and go after them criminally or in civil court.
Here is the big problem. If you withhold the money that could cast doubt upon any claims that you make as to them stealing. It could make it look like you did not pay them and claimed they stole because you really did not want to pay. That could be a lawsuit from their end. It can get very complicated.
The only real way to go about this if you have already fired them is to file criminal charges so then you will be able to pursue this in civil court. If you have not fired them you can still do this of course. But again you will need proof. And depending on the amount it might not even be worth the effort.
All in all what procedures for accountability do you have in place so that you can ultimately prove that this person stole from you. Now you sound convinced but what would stand in open court is another thing. |

It depends what he/she stole and if it was personal property. Are you a manager or something? If anything they should have gotton suspended or a written warning or even fired depending on what it was.Did they give the item back? Did they apologize? Do you have proof it was them that stole from you ? Take it out of their check and document everything because you have to pay for the time they worked but you also have the right to properly deal with a five finger discount employee. |
