Sons property insurance at school, who's responsible?
My Son was on a school excursion during this time his bag had been taken and a $300 pair of reading glasses had been purposely vandalised. (not the first time he has had property trashed at school, we know whop but cant prove it) The school says they cant claim insurance and nor can mine as they say its school responsibility. If this continues to happen where do I stand?

There may be coverage under your homeowners insurance (as long as your son is a resident relative of your household). In general, it covers your personal property away from your residence premises. If your homeowners insurance thinks the school should be responsible, then they will pursue subrogation against the school. However, I think that it will be a stretch to hold the school responsible. You would have to prove their negligence caused the property to be stolen. Therefore, I'd file a claim against your homeowners policy and see what happens. Let the claims adjuster decide if there is coverage or not. You will need a police report.

I wouldn't file a claim on my homeowner's insurance over a 300 pair of glasses. For a few reasons you deductible is probably higher, and your rate may likely increase over it, or if it does not increase the next time you need a claim on it it will increase when they see your frequency of claims.


But if I was you I would buy new glasses and make the teacher hold them for your child so they will not be damaged. It is the schools responsibility that this happened and I think you should continue to press them to pay for it, you could also bill the teacher for it. I would argue that if the teacher was doing their job and supervising the kids this would not of happened and they therefore should be held responsible.

i doubt the schools insurance would cover it. it's not their property, and there doesn't appear to be any negligence.

if i paid money to get cover under my home insurance for valuable off-site (ie spectacles) then i'd be really annoyed that my insurer told me to claim elsewhere because they feel it's someone else's responsibility. in my mind, if you do have the cover, your insurer is just being lazy. it shouldn't MATTER who is responsible. if they believed the school was at fault, they should pay you and pursue the school. this is how insurance works.

however, if your home cover simply doesn't extend to cover items outside the home, then you dont' really have a claim.

if this is actual vandalism, i would ensure it was reported to the police and let the cops deal with it. in the interim, make sure your son takes good care of his possessions.

I honestly don't know what to tell you. I remember back about 15 years ago where my brother had two $1000 dollar violins smashed by rival school members and my mother had to pay for them both as school insurance wouldn't cover them. I guess the moral of the story is to not take anything and leave it where someone else can get to it. Have him keep his glasses on him at all times. Maybe contact the other person's parent? Sorry this is happening. Bullies suck!

wow, this sucks.
I dont know how to speak to who gets these replaced, but I would file a police report, and contact the media.
I bet the money will arrive to replace the glasses around the time when the television crews show up.
