T.v. screen destroyed by visiting youngster?
my friend was visiting with her 6 yr. old son. he got very angry when we changed the channel on the t.v. and threw the remote into the t.v. screen destroying it. will my homeowners pay for it?

Probably not. The standard homeowners policy insures your "stuff" on a named perils basis. Although missles (flying objects) are a named peril, in order for damage by flying object to be covered, it first has to damage an outside wall of your house. In other words, it has to fly through the window or wall first, damaging that, AND the television.

However, if your friend has homeowners or renters insurance, her liability coverage SHOULD pay for the damage to your television.

Ask your friend to pay for the damage or put in a claim on their homeowners insurance. If you really want to push it, then take them to small claims.

Most people have a standard form of homeowners insurance (sometimes referred to as an HO-3 form). The standard policy covers damage to your personal property if it is caused by a peril specified in the policy. There are approximately 16 perils named. If the loss is due to a peril that is not listed in the form the loss is not covered.

Vandalism is one of those specified perils. However, I don't believe that a 6 year old child is capable (at least in a legal sense) of committing vandalism so I don't think you would have coverage.

Depending upon the value of the TV it may even be below your policy deductible. On the other hand if it is a supersize LCD or Plasma TV it might be worth pursuing the matter with your agent.

P.S. Due to the higher cost very few people choose what is called an "Open Perils" policy (often referred to as an HO-5 form). If you purchased that form this incident would be covered subject to your policy deductible.

Yes of course.... American child is known as bad behaved so this would be known risk and you are OK to claim. Why should friend take responsibility and pay $1,000 when neighbor can pay instead through more insurance premium of $1 each. America is fair country so all know they will be happy to do this.

If insurance company say no, you must hire lawyer to go through court. Many people here can tell you better than me how America is land of fairness in such matters.

Your Insurance probably has a deductible larger then the value of the set. However, you can sue your friend in small claims court if they won't pony up for the damage.

your friend with the 6 yr old should pay for it !!!!!!!!!!!!!!!

probably, but your deductible is prob higher than the cost of a new tv and your rates will go up on tip of it. Ask your friend to help pay for a new one since it was their kid that broke it....you can always sue her for reimbursement too.

What a little ****, it's very doubtful that your homeowner's insurance will pay for it, but I would definitely call and find out.

Your insurance should pay for it but, actually, your friend should pay for the damages. Did they even offer?
