The police report says its me fault????
Hi i have a question.. i was involved in a car accident in November 2007.I was driving along a main road.there was a driver ahead of me who indicated to turn onto his driveway.he drove onto the drive, but then reversed due to roadworks happening riht there and he didnt straighten his vehicle enough to fit on his drive.sooo he reveresed back into the main road in order to straighten his vehicle but he did so without looking.i couldnt stop in time by this point and as a result i hit him.Now after all this time, the third parties insurance company wont pay me compensation for whiplash because they apparently have a police report stating it is my fault? I had my then 9 month old son in the car with me at the time of the accident and i am such a careful driver. The guy whos car i hit, mysteriously found a witness to the accident about a month later, but at the time when the police arrived looking for witnesses, there was none. im just wondering what i can do now??

Police do not determine fault. They just don't.

Normally, someone backing out into the roadway that hits someone in the roadway, the backing out person is at fault.


You can hire a lawyer to sue the person who backed out. That's about it. Until a suit is filed, the other company has NO duty to do anything.

Depending on your state, whiplash, if that's your only injury, could very well be not compensable.

I would speak to your insurance company's claim office and report that there was no witness marked on the police report and therefore their statement is not acceptable. Also this person backed up into a main road and therefore they did not have priority on the road.

first of all your insurance company needs to work this out with his insurance company. 2nd, don't worry about the witness, if they weren't in the police report they can't be used after the fact.

But this is an issue for the insurance company. Thats why you have insurance!

Obtain a copy of the police report. If it assigns primary blame to you, there's not much you can do to dispute that, and its unlikely the other party's insurer will pay.

Did the other driver completely leave the road way or just start to turn then stopped with half his car still in the road?

If that is the case, then yes you are at fault. He never fully left the lane.

If he completely turned into the driveway out of the lane of traffic, then reversed back onto the road then it would most likely be his fault. There is a distance factor on that.

This is from personal experience. If he never fully left the lane, he still had the right of way.

The police report is not the gospel for determining fault on a claim. Ultimately though, it will need to be your insurer's claims adjuster who will need to be in your corner and if you can get him to agree with your assessment of fault then he would then go about collecting from the other party's insurer.
Unfortunately, if the details of the accident are unclear and unconfirmable then the information from the police report is probably going to stand.
