Yaniv H | UPS smashed my shipped plasma tv. How can i sue without using UPS insurance? |
I always send plasma tv's from my retail store through UPS with no problems. This time, when a plasma arrived, the entire package was messed up. I am not talking about just the plasma, but the box was crushed. It was like they dropped it over and over again. The corners are indented and the box is a rectangle no more. Because i always use UPS, i didn't do the insurance policy. They wont pay for the damages. I would agree if it was just the plasma because you cant be sure if it was broken before shipping or after, but in this case the entire box was beat up. Is there anything i can do? |

It is spelled out in the user agreement. They automatically insure your package for $100.00. If the package is worth more than that you need to purchase the insurance and make sure it is packaged correctly.
You could try filing a case with your insurance company. Next time pay their fee for the insurance, otherwise your pretty much out of luck. |

Just go ahead and sue. Just be warned, UPS does not have a lawyer,.,. they have a legal dept.
Be prepared to spend a lot of money to recover a lttle.
For my curiousity, what ins policy do you mean?? Their coverage, for an extra charge??
If you declined their extra coverage, I'm afraid you're out of luck. |

When you use UPS, there's a "small" amount of insurance build in. It won't cover a plasma tv, but it IS there.
Your only option is to sue them through small claims court - but be sure to look at the "fine print" that you sign every time you send a package - likely, it says something like, not responsible for damages occuring during shipping, unless seperate insurance is purchased. Which totally gets them off the hook. |

you get what you pay for in the freight world. UPS is such a great deal until they trash your plasma tv or whatever else you ship. accountability or liability for high damages come with a price. you either eat it or learn about shipping with other sources that may charge a little more but assume full liability. you are just another "Big Brown" statistic. |

contact a lawyer and file a civil suit for damages....be sure to have your previous shipments in order to prove that there has never been a problem until this time.... |
