Uninsured friend driving my car and accident happend, what happens now?
We were driving on highway and all of a suddent the truck ahead of us stoped because the car infront of this truck was going at a speed of 10 because she was playing with her phone (that is what the truck driver said).

Decision was quick and we passed both cars to avoid an accident with the truck; and my car trouched side of the 10miles/hr car. The cause of all of this was the 10 miles per hour car. Anyway she told police that she was going 40 mile per hour (lie). Accident looks like my car's fault but she caused it. Later the truck lady also stoped by to tell the policy that this girl was at max 10m/hr. Questions:

1) Since my friend was driving and he is not insured in my policy what is gonna happend to my insurance? Go up?
2) Is the fact that she was the cause of the incident ever be taken into acount either by the insurance policy or by the police?

why is your friend not on the policy? does she live with you? if you misrepresent the additional house hold driver you might not get covered. or is she just a permissive user?( meaning she doesn't live with you. she doesn't normally drive your car. )

if she is just a permissive user, whether or not your insurance will cover this depends on if your insurance company allows permissive users. some polices don't allow permissive uses.

your insurance shouldn't go up. you're not the driver. but your friend might now be added to the policy as an excluded driver.

keep a copy of the accident report for 3years showing that you were not the driver at the time of the accident. you'll need to be able to prove that for the next three years because your insurance company will more than likely report this to the CLUE report under collision. which will state that there was an at fault claims paid out. IF they do cover the claim.

Generally when you strike another vehicle in front of yours, you are considered at fault. Your insurance should cover the the accident as long as you allowed your friend to drive. Your insurance will likely increase your premium even though you were not driving. The police will not penalize you if you were not driving.

the bad news is that your friend is going to be found at fault for this. SHE hit the other car. the good news is that insurance follows the car NOT the driver, so your policy will cover the loss. she will be cited for the accident and she will get the points on her license but since your company will pay the claim, YOUR rates will increase as well as the payout will show under your policy.

your insurance should pay the claim they may drop you or theyll raise your premiums and you will pay for it for a long time anywhere from 3-5 years when you try to get other insurance they will see an accident that she had in your car and your ins. paid the claim so it will be on you loss history report so in the end you will pay for her mistake for the next few years sorry man whatch who you let drive your cars

The woman obstructing traffic may have been some cause, but your friend was obviously following to closely, and you have not given any explaination why he hit her after he cleared the truck.

So your friend passed unsafely and is more liable. If he does not pay for the damage, your insurance company should. But you will have to get money for your damage or deductable from him.

If your friend does not pay all of it himself, your rates may go up (or discounts would disappear) for a few years, depending upon the amount of damage.

You also shouldnt have passed-or let the UNINSURED driver pass the other vehicles. They hit the person it is their fault. No matter what, the accident was your drivers fault and nobody elses. Did the slow car veer into your lane-or shoulder as it was? Probably not, therefore again it was your fault. Thats what you get for letting uninsured drivers drive your car. At least you didnt kill anybody. I have NO sympathy for uninsured drivers or people who allow them to drive. And yes your insurance will cover the permissive use accident but it will go on your record and make your insurance go up.

1. It depends on the friend, how often they drive, and the circumstances why they were driving. It's possible your insurance will NOT go up. But if your friend drives regularly, the insurance company will now require you to list them on your policy (which will make it go up, now that they have an at fault accident), or specifically exclude them from coverage.
2. Probably not. Your friend lost control of the car, or else they wouldn't have swerved into the other lane, touching Ms. Slowcar.

Your insurance should cover your car - no matter who was driving it.

Sounds like your screwed. It will go against your insurance. Don't let uninsured drivers drive your car. It's an "accident" waiting to happen.
