Sharon C | We are a pre-school facing closure. we never signed our rent agreement is it still legally binding? |

Depends how long you have been there and that you have been regularly paying rent. If they gave you an agreement it still stands even though you didnt sign it. |

I'm assuming there was some verbal agreement. If that's the case then that is binding if the landlord has some means of proving the agreement. ie proof exists because of actions on your part, etc. |

It sounds to me like you have a month-to-month lease. I do not believe that you would be required to pay anything outside of the current month that you last occupy. If you verbally agreed to something different, then I guess they might have an argument, but with no proof of the verbal agreement, well, verbal agreements tend to be worth the paper that they are written on... |

I have to say that if you've not signed the agreement then in theory it is not legally binding. However a solicitor may argue that ownership of the lease agreement by you proves knowledge of the lease agreement. A solicitor may argue further that despite you not signing the agreement that your knowledge of it and the fact that you occupied the premises constitutes the same legal standing as if you had signed the agreement. Just give your landlord one months notice and see how things go. |

If you have been turning up and using the hall and the hall has allowed you to use it, then you have a contract. Is this a village or community hall - in this case, I would guess they would be kind to you and be able to negotiate a way out. If it's a commercial operation, they might not be so kind.
As your trustees are liable for any unpaid debts (assuming you are not a company limited by guarantee), you need to use all your negotiating skills to get out of this. Can the PLA help, or your local CVS? What lengths have you gone to to obtain funding? |

You probably want a lawyer to get into any specific disagreements you have, but according to the statute of frauds, any contract with a value over $500 must be in writing. |

Well if you never signed a rental agreement then they can accuse and charge you with trespassing
See if there's a way something can be worked out (thats if you want to stay there) |
