slide | What are my options for health insurance if I resign from my job due to not being paid for the last 4 months.? |
I work for a small company and currently have health coverage through a plan with them. They have not paid their employees for approximately the last 4 months. If I resign because they are not paying my wages, what are my options for health insurance? Am I eligible for COBRA? What happens if the company goes bankrupt? |

You're only eligible for Cobra, if they have more than 25 employees, AND they currently have a health insurance plan. If they haven't made payroll, odds are, they haven't paid the health insurance premiums, either.
As soon as their group health policy cancels, so does your cobra. So if they go under, so do your COBRA benefits.
Best option is to find a new job NOW, and jump ship, even if you're flipping burgers somewhere. At LEAST you'll get paid. |

You are eligible for Cobra if your company has more than 20 employees. Your company's bankruptcy will not affect your eligibility for Cobra. However, an individual policy is going to cost a lot less, and you can keep it until you turn 65. The policies available depend on where you live, and an experienced agent can narrow down your options to one that best fits your needs in just a few minutes. Avoid the online shopping, there is just simply too much information, and too many scams to watch out for.

You are eligible for COBRA. This just covers you for a relatively short period of time and gives you time to either find another job that has health insurance coverage or to get it on your own. In either case you should receive a certificate of health coverage from your current health insurance provider. That allows you to get coverage on your own without a waiting period for existing health problems. |

Cobra. But I would check with your local DHS and see if you qualify for any coverage through them. COBRA is very expensive.
How are you living w/o being paid? I can't believe anyone is still working there after 4 months!
Are you filing a suit with them for your wages? you should! |

If they are not paying your wages, are you sure they are paying the insurance premiums? This happened to me many years ago and I got a bill from the doctors office 6 months down the road, after I assumed it had been paid by the insurance policy that was canceled due to non-payment of premiums!
Watch Out! |
